    حَدَّثَنَا أَبُو إِسْحَاقَ الْهَرَوِيُّ، إِبْرَاهِيمُ بْنُ عَبْدِ اللَّهِ بْنِ حَاتِمٍ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْحَارِثِ الْمَخْزُومِيُّ، حَدَّثَنَا سَيْفُ بْنُ سُلَيْمَانَ الْمَكِّيُّ، أَخْبَرَنِي قَيْسُ بْنُ سَعْدٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم بِالشَّاهِدِ وَالْيَمِينِ ‏.‏

    It was narrated that Ibn ‘Abbas said: “The Messenger of Allah (ﷺ) passed judgement on the basis of a witness along with an oath by the claimant.

    Chapter: A Man Giving A Gift To His Son

    حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ يُوسُفَ الْعَرْعَرِيُّ، حَدَّثَنَا يَزِيدُ بْنُ أَبِي حَكِيمٍ، حَدَّثَنَا الْعُمَرِيُّ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ الْعَائِدُ فِي هِبَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ ‏” ‏ ‏.‏

    It was narrated from Ibn`Umar that the Prophet (ﷺ) said: “The one who takes back his gift is like the dog that goes back to its vomit.”

    Chapter: Mention Of Judges

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا جُوَيْرِيَةُ بْنُ أَسْمَاءَ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ، – مَوْلَى الْمُنْبَعِثِ – عَنْ رَجُلٍ، مِنْ أَهْلِ مِصْرَ عَنْ سُرَّقٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم أَجَازَ شَهَادَةَ الرَّجُلِ وَيَمِينَ الطَّالِبِ ‏.‏

    It was narrated from Surraq that : the Prophet (ﷺ) allowed the testimony of a man along with the oath of the claimant.

    Chapter: Mention Of Judges

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ، حَدَّثَنَا سُفْيَانُ الْعُصْفُرِيُّ، عَنْ أَبِيهِ، عَنْ حَبِيبِ بْنِ النُّعْمَانِ الأَسَدِيِّ، عَنْ خُرَيْمِ بْنِ فَاتِكٍ الأَسَدِيِّ، قَالَ صَلَّى النَّبِيُّ صلى الله عليه وسلم الصُّبْحَ فَلَمَّا انْصَرَفَ قَامَ قَائِمًا فَقَالَ ‏”‏ عُدِلَتْ شَهَادَةُ الزُّورِ بِالإِشْرَاكِ بِاللَّهِ ‏”‏ ‏.‏ ثَلاَثَ مَرَّاتٍ ثُمَّ تَلاَ هَذِهِ الآيَةَ ‏ {‏وَاجْتَنِبُوا قَوْلَ الزُّورِ حُنَفَاءَ لِلَّهِ غَيْرَ مُشْرِكِينَ بِه‏} ‏‏.‏

    It was narrated that Khuraim bin Fatik Al-Asadi said that : the Prophet(ﷺ) prayed the Morning prayer, and when he had finished, he stood up and said: “Bearing false witness is equivalent to associating others with Allah,” three times. Then he recited this Verse: “And shun lying speech (false statements), Hunafa’ Lillah (i.e., worshiping none but Allah), not associating partners (in worship) to Him.”

    حَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ، حَدَّثَنَا مُحَمَّدُ بْنُ الْفُرَاتِ، عَنْ مُحَارِبِ بْنِ دِثَارٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏{‏لَنْ تَزُولَ قَدَمُ شَاهِدِ الزُّورِ حَتَّى يُوجِبَ اللَّهُ لَهُ النَّارَ‏}‏‏.‏

    It was narrated from Ibn ‘Umar that the Messenger of Allah (ﷺ) said: ‘The one who bears false witness will not move away (on the Day of Resurrection) until Allah condemns him to Hell.’ ”

    حَدَّثَنَا مُحَمَّدُ بْنُ طَرِيفٍ، حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، عَنْ مُجَالِدٍ، عَنْ عَامِرٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أَجَازَ شَهَادَةَ أَهْلِ الْكِتَابِ بَعْضِهِمْ عَلَى بَعْضٍ ‏.‏

    It was narrated from Jabir bin ‘Abdullah that : the Messenger of Allah (ﷺ) allowed the People of the Book to testify against one another.

    حَدَّثَنَا أَبُو بِشْرٍ، بَكْرُ بْنُ خَلَفٍ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، قَالَ انْطَلَقَ بِهِ أَبُوهُ يَحْمِلُهُ إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَ اشْهَدْ أَنِّي قَدْ نَحَلْتُ النُّعْمَانَ مِنْ مَالِي كَذَا وَكَذَا ‏.‏ قَالَ ‏”‏ فَكُلَّ بَنِيكَ نَحَلْتَ مِثْلَ الَّذِي نَحَلْتَ النُّعْمَانَ ‏”‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏”‏ فَأَشْهِدْ عَلَى هَذَا غَيْرِي ‏”‏ ‏.‏ قَالَ ‏”‏ أَلَيْسَ يَسُرُّكَ أَنْ يَكُونُوا لَكَ فِي الْبِرِّ سَوَاءً ‏”‏ ‏.‏ قَالَ بَلَى ‏.‏ قَالَ ‏”‏ فَلاَ إِذًا ‏”‏ ‏.‏

    It was narrated that Nu’man bin Bashir said that his father took him to the Prophet (ﷺ) and said: “Bear witness that I have given Nu’man such and such from my wealth.” He said: “Have you given all your children something like that which you have given to Nu’man?” He said: “No.” He said: “Then let someone other than me bear witness to that.” And he said: “Would you not like all your children to honor you equally?” He said: “Of course.” He said: “Then do not do this.”

    حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ، وَمُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَخْبَرَاهُ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّ أَبَاهُ، نَحَلَهُ غُلاَمًا وَأَنَّهُ جَاءَ إِلَى النَّبِيِّ صلى الله عليه وسلم يُشْهِدُهُ فَقَالَ ‏”‏ أَكُلَّ وَلَدِكَ نَحَلْتَ ‏”‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏”‏ فَارْدُدْهُ ‏”‏ ‏.‏

    It was narrated from Nu’man bin Bashir that: his father gave him a gift of a slave, and he came to the Prophet (ﷺ) so that he could witness the gift. He said: “Have you given something to all of your children?” He said: “No.” He said: “Then take back (your gift).”

    حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، وَأَبُو بَكْرِ بْنُ خَلاَّدٍ الْبَاهِلِيُّ قَالاَ حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، عَنْ حُسَيْنٍ الْمُعَلِّمِ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، وَابْنِ، عُمَرَ يَرْفَعَانِ الْحَدِيثَ إِلَى النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ لاَ يَحِلُّ لِلرَّجُلِ أَنْ يُعْطِيَ الْعَطِيَّةَ ثُمَّ يَرْجِعَ فِيهَا إِلاَّ الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ ‏” ‏ ‏.‏

    It was narrated from Ibn ‘Abbas and Ibn ‘Umar, who attributed the Hadith to the Prophet (ﷺ) that he said: “It is not permissible for a man to give a gift then take it back, except what a father gives to his child.”

    حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، وَعَمْرُو بْنُ رَافِعٍ، قَالاَ حَدَّثَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَبِيدَةَ السَّلْمَانِيِّ، قَالَ قَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ سُئِلَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَىُّ النَّاسِ خَيْرٌ قَالَ ‏ “‏ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ قَوْمٌ تَبْدُرُ شَهَادَةُ أَحَدِهِمْ يَمِينَهُ وَيَمِينُهُ شَهَادَتَهُ ‏” ‏ ‏.‏

    ‘Abdullah bin Mas’ud said: “The Messenger of Allah (ﷺ) was asked, ‘Which of the people are best?’ He said: ‘My generation, then those that follow them, then those that follow them. Then there will come people whose testimony precedes their oath and whose oath precedes their testimony.”
