    Chapter: Divorce

    حَدَّثَنَا مُحَمَّدُ بْنُ عُمَرَ بْنِ هَيَّاجٍ، حَدَّثَنَا قَبِيصَةُ بْنُ عُقْبَةَ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ مَيْمُونٍ، عَنْ أَبِيهِ، عَنِ الزُّبَيْرِ بْنِ الْعَوَّامِ، أَنَّهُ كَانَتْ عِنْدَهُ أُمُّ كُلْثُومٍ بِنْتُ عُقْبَةَ فَقَالَتْ لَهُ وَهِيَ حَامِلٌ طَيِّبْ نَفْسِي بِتَطْلِيقَةٍ ‏.‏ فَطَلَّقَهَا تَطْلِيقَةً ثُمَّ خَرَجَ إِلَى الصَّلاَةِ فَرَجَعَ وَقَدْ وَضَعَتْ ‏.‏ فَقَالَ مَالَهَا خَدَعَتْنِي خَدَعَهَا اللَّهُ ثُمَّ أَتَى النَّبِيَّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ “‏ سَبَقَ الْكِتَابُ أَجَلَهُ اخْطُبْهَا إِلَى نَفْسِهَا ‏” ‏ ‏.‏

    It was narrated from Zubair bin ‘Awwam that: he was married to Umm Kulthum bint ‘Uqbah, and she said to him when she was pregnant. “I will accept one divorce.” So he divorced her once. Then he went out for prayer, and when he came back she had given birth. He said: “What is wrong with her? She misled me may Allah mislead her!” Then he came to the Prophet (ﷺ), who said: “Her waiting period is over (and she is divorced); propose marriage a new to her.”

    Chapter: What was narrated concerning the virtue of marriage

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَحْيَى بْنُ إِسْحَاقَ، حَدَّثَنَا يَحْيَى بْنُ أَيُّوبَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ نَوْفَلٍ الْقُرَشِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، عَنْ جُدَامَةَ بِنْتِ وَهْبٍ الأَسَدِيَّةِ، أَنَّهَا قَالَتْ سَمِعْتُ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ يَقُولُ ‏”‏ قَدْ أَرَدْتُ أَنْ أَنْهَى عَنِ الْغِيَالِ فَإِذَا فَارِسُ وَالرُّومُ يُغِيلُونَ فَلاَ يَقْتُلُونَ أَوْلاَدَهُمْ ‏”‏ ‏.‏ وَسَمِعْتُهُ يَقُولُ وَسُئِلَ عَنِ الْعَزْلِ فَقَالَ ‏”‏ هُوَ الْوَأْدُ الْخَفِيُّ ‏”‏ ‏.‏

    It was narrated that Judamah bint Wahb Al-Asadiyyah said: “I heard the Messenger of Allah say: ‘I wanted to forbid intercourse with a nursing mother, but then (I saw that) the Persians and the Romans do this, and it does not kill their children.’ And I heard him say/when he was asked about coitus interruptus: ‘It is the disguised form of b.rryirg children alive.”

    Chapter: What was narrated concerning the virtue of marriage

    حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ، عَنْ عَمْرِو بْنِ مُهَاجِرٍ، أَنَّهُ سَمِعَ أَبَاهُ الْمُهَاجِرَ بْنَ أَبِي مُسْلِمٍ، يُحَدِّثُ عَنْ أَسْمَاءَ بِنْتِ يَزِيدَ بْنِ السَّكَنِ، وَكَانَتْ، مَوْلاَتَهُ أَنَّهَا سَمِعَتْ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ يَقُولُ ‏ “‏ لاَ تَقْتُلُوا أَوْلاَدَكُمْ سِرًّا فَوَالَّذِي نَفْسِي بِيَدِهِ إِنَّ الْغَيْلَ لَيُدْرِكُ الْفَارِسَ عَلَى ظَهْرِ فَرَسِهِ حَتَّى يَصْرَعَهُ ‏” ‏ ‏.‏

    It was narrated from Muhajir bin Abu Muslim, from Asma’ bint Yazid bin Sakary who was his freed slave womary that: she heard the Messenger of Allah say: “Do not kill your children secretly, for by the One in Whose Hand is my soul, intercourse with a breastfeeding woman catches up with people when they are riding their horses (in battle) and wrestles them to the ground.”

    حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُؤَمَّلٌ، حَدَّثَنَا سُفْيَانُ، عَنِ الأَعْمَشِ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ أَبِي أُمَامَةَ، قَالَ أَتَتِ النَّبِيَّ ـ صلى الله عليه وسلم ـ امْرَأَةٌ مَعَهَا صَبِيَّانِ لَهَا قَدْ حَمَلَتْ أَحَدَهُمَا وَهِيَ تَقُودُ الآخَرَ فَقَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ “‏ حَامِلاَتٌ وَالِدَاتٌ رَحِيمَاتٌ لَوْلاَ مَا يَأْتِينَ إِلَى أَزْوَاجِهِنَّ دَخَلَ مُصَلِّيَاتُهُنَّ الْجَنَّةَ ‏” ‏ ‏.‏

    It was narrated that Abu Umamah said: “A woman came to the Prophet with two of her children, carrying one and leading the other. The Messenger of Allah said: ‘They carry children and give birth to them and are compassionate. If they do not annoy their husbands, those among them who perform prayer will enter Paradise.”‘

    حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ الضَّحَّاكِ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ بَحِيرِ بْنِ سَعْدٍ، عَنْ خَالِدِ بْنِ مَعْدَانَ، عَنْ كَثِيرِ بْنِ مُرَّةَ، عَنْ مُعَاذِ بْنِ جَبَلٍ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ “‏ لاَ تُؤْذِي امْرَأَةٌ زَوْجَهَا إِلاَّ قَالَتْ زَوْجَتُهُ مِنَ الْحُورِ الْعِينِ لاَ تُؤْذِيهِ قَاتَلَكِ اللَّهُ فَإِنَّمَا هُوَ عِنْدَكِ دَخِيلٌ أَوْشَكَ أَنْ يُفَارِقَكِ إِلَيْنَا ‏” ‏ ‏.‏

    It was narrated from Mu’adh bin Jabal that: the Messenger of Allah said: “No woman annoys her husband but his wife among houris (of Paradise) safs: ‘Do not annoy him, may Allah destroy you, for he is just a temporary guest with you and soon he will leave you and join us.”‘

    حَدَّثَنَا يَحْيَى بْنُ مُعَلَّى بْنِ مَنْصُورٍ، حَدَّثَنَا إِسْحَاقُ بْنُ مُحَمَّدٍ الْفَرْوِيُّ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ ـ صلى الله عليه وسلم ـ قَالَ ‏ “‏ لاَ يُحَرِّمُ الْحَرَامُ الْحَلاَلَ ‏” ‏ ‏.‏

    It was narrated from Ibn ‘Umar that: the Prophet, said: “What is Haram does not make what is Halal into what is Haram.”

    حَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ، وَعَبْدُ اللَّهِ بْنُ عَامِرِ بْنِ زُرَارَةَ، وَمَسْرُوقُ بْنُ الْمَرْزُبَانِ، قَالُوا حَدَّثَنَا يَحْيَى بْنُ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ، عَنْ صَالِحِ بْنِ صَالِحِ بْنِ حَىٍّ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، عَنْ عُمَرَ بْنِ الْخَطَّابِ، ‏.‏ أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا ‏.‏

    It was narrated from ‘Umar bin Khattab that: the Messenger of Allah divorced Hafsah then took her back.

    حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُؤَمَّلٌ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي بُرْدَةَ، عَنْ أَبِي مُوسَى، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ “‏ مَا بَالُ أَقْوَامٍ يَلْعَبُونَ بِحُدُودِ اللَّهِ يَقُولُ أَحَدُهُمْ قَدْ طَلَّقْتُكِ قَدْ رَاجَعْتُكِ ‏.‏ قَدْ طَلَّقْتُكِ ‏” ‏ ‏.‏

    It was narrated from Abu Musa that: the Messenger of Allah said: What is wrong with people who play with the limits imposed by Allah, and one of them says: “I divorce you, I take you back, I divorce you?”

    حَدَّثَنَا كَثِيرُ بْنُ عُبَيْدٍ الْحِمْصِيُّ، حَدَّثَنَا مُحَمَّدُ بْنُ خَالِدٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ الْوَلِيدِ الْوَصَّافِيِّ، عَنْ مُحَارِبِ بْنِ دِثَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ “‏ أَبْغَضُ الْحَلاَلِ إِلَى اللَّهِ الطَّلاَقُ ‏” ‏ ‏.‏

    It was narrated from ‘Abdullah bin ‘Umar that: the Messenger of Allah said: “The most hated of permissible things to Allah is divorce. ”

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ، عَنْ عُبَيْدِ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِرَسُولِ اللَّهِ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ “‏ مُرْهُ فَلْيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ طَلَّقَهَا قَبْلَ أَنْ يُجَامِعَهَا وَإِنْ شَاءَ أَمْسَكَهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ ‏” ‏ ‏.‏

    It was narrated that Ibn ‘Umar said: “I divorced my wife when she was menstruating. ‘Umar mentioned that to the Messenger of Allah and he said: ‘Tell him to take her back until she becomes pure (i.e., her period ends), then she has her period (again), then she becomes pure (again), then if he wishes he may divorce her before having sexual relations with her, and if he wishes he may keep her. This is the waiting period that Allah has enjoined.’”
