    Chapter: Divorce

    حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ سُفْيَانَ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي الأَحْوَصِ، عَنْ عَبْدِ اللَّهِ، قَالَ طَلاَقُ السُّنَّةِ أَنْ يُطَلِّقَهَا طَاهِرًا مِنْ غَيْرِ جِمَاعٍ ‏.‏

    It was narrated that Abdullah said: “Divorce according to the Sunnah means divorcing her when she is pure, ( i.e., not menstruating) and without having had intercourse with her (during that cycle).”

    حَدَّثَنَا عَلِيُّ بْنُ مَيْمُونٍ الرَّقِّيُّ، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ، عَنِ الأَعْمَشِ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي الأَحْوَصِ، عَنْ عَبْدِ اللَّهِ، قَالَ طَلاَقُ السُّنَّةِ يُطَلِّقُهَا عِنْدَ كُلِّ طُهْرٍ تَطْلِيقَةً فَإِذَا طَهُرَتِ الثَّالِثَةَ طَلَّقَهَا وَعَلَيْهَا بَعْدَ ذَلِكَ حَيْضَةٌ ‏.‏

    It was narrated that ‘Abdullah said: “Divorce according to the Sunnah means divorcing her with one divorce in each cycle when she is pure, then when she becomes pure the third time, then he pronounces divorce again, and after that she must wait one more menstrual cycle.”

    حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْجَهْضَمِيُّ، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا هِشَامٌ، عَنْ مُحَمَّدٍ، عَنْ يُونُسَ بْنِ جُبَيْرٍ أَبِي غَلاَّبٍ، قَالَ سَأَلْتُ ابْنَ عُمَرَ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ‏.‏ قُلْتُ أَيُعْتَدُّ بِتِلْكَ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

    It was narrated that Yunus bin Jubair, Abu Ghallab, said: “I asked Ibn ‘Umar about a man who divorced his wife when she was menstruating. He said: ‘Do you know ‘Abdullah bin ‘Umar? He divorced his wife when she was menstruating then ‘Umar came to the Prophet (ﷺ) (and told him what had happened). He ordered him to take her back.’ I said: ‘Will that be counted (as a divorce)?’ He said: ‘Do You think he was helpless and behaving foolishly? [i.e., Yes, it counts (as a divorce).].”‘

    Chapter: What was narrated concerning the virtue of marriage

    حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، حَدَّثَنَا شُرَحْبِيلُ بْنُ مُسْلِمٍ، قَالَ سَمِعْتُ أَبَا أُمَامَةَ الْبَاهِلِيَّ، يَقُولُ سَمِعْتُ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ يَقُولُ ‏ “‏ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ ‏” ‏ ‏.‏

    Shurahbil bin Muslim said: “I heard Abu Um Amah Al-Bahili say: ‘I heard the Messenger of Allah say: “The child is for the bed and the fornicator gets nothing.”

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَعَلِيُّ بْنُ مُحَمَّدٍ، قَالاَ حَدَّثَنَا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، مَوْلَى آلِ طَلْحَةَ عَنْ سَالِمٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ “‏ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرٌ أَوْ حَامِلٌ ‏” ‏ ‏.‏

    It was narrated from Ibn ‘Umar that: he divorced his wife when she was menstruating, and ‘Umar mentioned that to the Prophet (ﷺ). He said: “Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant.”

    Chapter: What was narrated concerning the virtue of marriage

    حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ، حَدَّثَنَا حَفْصُ بْنُ جُمَيْعٍ، حَدَّثَنَا سِمَاكٌ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ امْرَأَةً، جَاءَتْ إِلَى النَّبِيِّ ـ صلى الله عليه وسلم ـ فَأَسْلَمَتْ ‏.‏ فَتَزَوَّجَهَا رَجُلٌ ‏.‏ قَالَ فَجَاءَ زَوْجُهَا الأَوَّلُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي قَدْ كُنْتُ أَسْلَمْتُ مَعَهَا وَعَلِمَتْ بِإِسْلاَمِي ‏.‏ قَالَ فَانْتَزَعَهَا رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ مِنْ زَوْجِهَا الآخَرِ وَرَدَّهَا إِلَى زَوْجِهَا الأَوَّلِ ‏.‏

    It was narrated from Ibn ‘Abbas that: a woman came to the Prophet and became Muslim, and a man married her. Then her first husband came and said: “O Messenger of Allah, I became Muslim with her, and she knew that I was Muslim.” So the Messenger of Allah took her away from her second husband and returned her to her first husband.

    حَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ، أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ إِسْحَاقَ بْنِ أَبِي فَرْوَةَ، عَنْ أَبِي الزِّنَادِ، عَنْ عَامِرٍ الشَّعْبِيِّ، قَالَ قُلْتُ لِفَاطِمَةَ بِنْتِ قَيْسٍ حَدِّثِينِي عَنْ طَلاَقِكِ، ‏.‏ قَالَتْ طَلَّقَنِي زَوْجِي ثَلاَثًا وَهُوَ خَارِجٌ إِلَى الْيَمَنِ فَأَجَازَ ذَلِكَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏.‏

    It was narrated that ‘Amir Sha’bi said: “I said to Fatimah bint Qais: ‘Tell me about your divorce.’ She said: ‘My husband divorced me three times when he was leaving for Yemen, and the Messenger of Allah (ﷺ) allowed that.”‘

    حَدَّثَنَا أَبُو بَكْرِ بْنُ خَلاَّدٍ، وَيَحْيَى بْنُ حَكِيمٍ، قَالاَ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا مُحَمَّدُ بْنُ إِسْحَاقَ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ رَدَّ ابْنَتَهُ عَلَى أَبِي الْعَاصِ بْنِ الرَّبِيعِ بَعْدَ سَنَتَيْنِ بِنِكَاحِهَا الأَوَّلِ ‏.‏

    It was narrated from Ibn ‘Abbas that: the Messenger of Allah returned his daughter to Abul-‘As bin Rabi’ after two years, on the basis of the first marriage contract.

    حَدَّثَنَا بِشْرُ بْنُ هِلاَلٍ الصَّوَّافُ، حَدَّثَنَا جَعْفَرُ بْنُ سُلَيْمَانَ الضُّبَعِيُّ، عَنْ يَزِيدَ الرِّشْكِ، عَنْ مُطَرِّفِ بْنِ عَبْدِ اللَّهِ بْنِ الشِّخِّيرِ، أَنَّ عِمْرَانَ بْنَ الْحُصَيْنِ، سُئِلَ عَنْ رَجُلٍ، يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقَعُ بِهَا وَلَمْ يُشْهِدْ عَلَى طَلاَقِهَا وَلاَ عَلَى رَجْعَتِهَا ‏.‏ فَقَالَ عِمْرَانُ طَلَّقْتَ بِغَيْرِ سُنَّةٍ وَرَاجَعْتَ بِغَيْرِ سُنَّةٍ أَشْهِدْ عَلَى طَلاَقِهَا وَعَلَى رَجْعَتِهَا ‏.‏

    ‘Imran bin Husain: was asked about a man who divorced his wife then had intercourse with her, and there were no witnesses to his divorcing her or his taking her back. ‘Imran said: “You have divorced (her) in a manner that is not according to the Sunnah, and you have taken her back in a manner that is not according to the Sunnah. Bring people to witness your divorcing her and taking her back.”

    حَدَّثَنَا عَبْدُ السَّلاَمِ بْنُ عَاصِمٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نَافِعٍ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ أَبِي حَازِمٍ، عَنْ سَهْلِ بْنِ سَعْدٍ، أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ قَالَ ‏ “‏ إِنْ كَانَ فَفِي الْفَرَسِ وَالْمَرْأَةِ وَالْمَسْكَنِ ‏” ‏ ‏.‏ يَعْنِي الشُّؤْمَ ‏.‏

    It was narrated from Sahl bin Sa’d that: the Messenger of Allah said: “If it exists, it is in three things: a horse, and woman and a house,” meaning omens.
