    حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، أَخْبَرَنَا إِسْمَاعِيلُ بْنُ جَعْفَرٍ، حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدٍ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ ‏.‏ قَالَ وَقَضَى بِهَا عَلِيٌّ فِيكُمْ ‏.‏ قَالَ أَبُو عِيسَى وَهَذَا أَصَحُّ وَهَكَذَا رَوَى سُفْيَانُ الثَّوْرِيُّ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنِ النَّبِيِّ صلى الله عليه وسلم مُرْسَلاً ‏.‏ وَرَوَى عَبْدُ الْعَزِيزِ بْنُ أَبِي سَلَمَةَ وَيَحْيَى بْنُ سُلَيْمٍ هَذَا الْحَدِيثَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ عَلِيٍّ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ رَأَوْا أَنَّ الْيَمِينَ مَعَ الشَّاهِدِ الْوَاحِدِ جَائِزٌ فِي الْحُقُوقِ وَالأَمْوَالِ ‏.‏ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ وَقَالُوا لاَ يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ إِلاَّ فِي الْحُقُوقِ وَالأَمْوَالِ ‏.‏ وَلَمْ يَرَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ أَنْ يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ ‏.‏

    Ja’far bin Muhammad narrated from his father: “The Prophet (ﷺ) passed judgement based on an oath along with one witness.” He said: “And ‘Ali judged between you based on it.”

    حَدَّثَنَا عَبْدُ الْقُدُّوسِ بْنُ مُحَمَّدٍ أَبُو بَكْرٍ الْعَطَّارُ، حَدَّثَنَا عَمْرُو بْنُ عَاصِمٍ، حَدَّثَنَا عِمْرَانُ الْقَطَّانُ، عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي أَوْفَى، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ إِنَّ اللَّهَ مَعَ الْقَاضِي مَا لَمْ يَجُرْ فَإِذَا جَارَ تَخَلَّى عَنْهُ وَلَزِمَهُ الشَّيْطَانُ ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ غَرِيبٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِ عِمْرَانَ الْقَطَّانِ ‏.‏

    [‘Abdullah] Ibn Abi Al-Awfa narrated that the Messenger of Allah (ﷺ) said: “[Indeed] Allah is with the judge as long as he is not unjust. So when he is unjust, He leaves him and he is attended by Shaitan.”

    Chapter: What Has Been Related From The Messenger of Allah About The Judge

    حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ مَنْ أَعْتَقَ نَصِيبًا – أَوْ قَالَ شِقْصًا أَوْ قَالَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ فَهُوَ عَتِيقٌ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ‏” ‏ ‏.‏ قَالَ أَيُّوبُ وَرُبَّمَا قَالَ نَافِعٌ فِي هَذَا الْحَدِيثِ يَعْنِي فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رَوَاهُ سَالِمٌ عَنْ أَبِيهِ عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَهُ ‏.‏

    Ibn ‘Umar narrated that the Prophet (ﷺ) said: “Whoever frees a portion” or, he said: “a part” or he said: “a share he owns of a slave, then he can afford the remainder of the price according to the reasonable price, then he will be free. Otherwise he has freed as much as he has freed (only).” Ayyub (one of the narrators) said: “Perhaps Nafi said in this Hadith: ‘Meaning he has freed as much of him as he has freed.’”

    حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلاً، تَقَاضَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَأَغْلَظَ لَهُ فَهَمَّ بِهِ أَصْحَابُهُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏”‏ دَعُوهُ فَإِنَّ لِصَاحِبِ الْحَقِّ مَقَالاً ‏”‏ ثُمَّ قَالَ ‏”‏ اشْتَرُوا لَهُ بَعِيرًا فَأَعْطُوهُ إِيَّاهُ ‏”‏ ‏.‏ فَطَلَبُوهُ فَلَمْ يَجِدُوا إِلاَّ سِنًّا أَفْضَلَ مِنْ سِنِّهِ ‏.‏ فَقَالَ ‏”‏ اشْتَرُوهُ فَأَعْطُوهُ إِيَّاهُ فَإِنَّ خَيْرَكُمْ أَحْسَنُكُمْ قَضَاءً ‏”‏ ‏.‏

    Narrated Abu Hurairah: “A man behaved in a rude manner while trying to collect a debt from the Messenger of Allah (ﷺ). So his Companions were about to harm him. The Messenger of Allah (ﷺ) said: ‘Leave him, for indeed the owner of the the right has the right to speak.’ Then he said: ‘Purchase a camel for him and give it to him.’ So they searched out but they did not find a camel but of a better ager than his camel. So he said: ‘Buy it and give it to him. For indeed the best of you is the best in repaying.’”

    حَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ، مَوْلَى رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ اسْتَسْلَفَ رَسُولُ اللَّهِ صلى الله عليه وسلم بَكْرًا فَجَاءَتْهُ إِبِلٌ مِنَ الصَّدَقَةِ ‏.‏ قَالَ أَبُو رَافِعٍ فَأَمَرَنِي رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ ‏.‏ فَقُلْتُ لاَ أَجِدُ فِي الإِبِلِ إِلاَّ جَمَلاً خِيَارًا رَبَاعِيًّا ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ أَعْطِهِ إِيَّاهُ فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

    Narrated Abu Rafi’, the freed slave of the Messenger of Allah (ﷺ): “The Messenger of Allah got a camel in advance. Some camels from the charity.” Abu Rafi’ said: “So the Messenger of Allah (ﷺ) told me to pay the man back for his camel. I said: ‘I did not find among the camels but a superior selection of Raba’. The Messenger of Allah (ﷺ) said: ‘Give it to him, for indeed the base of people is the best of them in repaying.’” [Abu ‘Eisa said:] This Hadith is Hasan Sahih.

    حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا إِسْحَاقُ بْنُ سُلَيْمَانَ الرَّازِيُّ، عَنْ مُغِيرَةَ بْنِ مُسْلِمٍ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ “‏ إِنَّ اللَّهَ يُحِبُّ سَمْحَ الْبَيْعِ سَمْحَ الشِّرَاءِ سَمْحَ الْقَضَاءِ ‏” ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ جَابِرٍ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ غَرِيبٌ ‏.‏ وَقَدْ رَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ عَنْ يُونُسَ عَنْ سَعِيدٍ الْمَقْبُرِيِّ عَنْ أَبِي هُرَيْرَةَ ‏.‏

    Narrated Abu Hurairah: That the Messenger of Allah (ﷺ) said: “Indeed Allah loves tolerance in selling, tolerance in buying, and tolerance in repaying.” He said: There is something on this topic from Jabir. [Abu ‘Eisa said:] This Hadith is Gharib. Some of them reported this Hadith from Yunus, from Sa’eed Al-Maqburi, from Abu Hurairah.

    حَدَّثَنَا عَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ، حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، أَخْبَرَنَا إِسْرَائِيلُ، عَنْ زَيْدِ بْنِ عَطَاءِ بْنِ السَّائِبِ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ غَفَرَ اللَّهُ لِرَجُلٍ كَانَ قَبْلَكُمْ كَانَ سَهْلاً إِذَا بَاعَ سَهْلاً إِذَا اشْتَرَى سَهْلاً إِذَا اقْتَضَى ‏” ‏ ‏.‏ قَالَ هَذَا حَدِيثٌ صَحِيحٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ ‏.‏

    Narrated Jabir: That the Messenger of Allah (ﷺ) said: “Allah forgave a man who was before you: He was tolerant when selling, tolerant when purchasing, and tolerant when repaying.” He said: This Hadith is Gharib Sahih Hasan from this route.

    حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْخَلاَّلُ، حَدَّثَنَا عَارِمٌ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، أَخْبَرَنَا يَزِيدُ بْنُ خُصَيْفَةَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ “‏ إِذَا رَأَيْتُمْ مَنْ يَبِيعُ أَوْ يَبْتَاعُ فِي الْمَسْجِدِ فَقُولُوا لاَ أَرْبَحَ اللَّهُ تِجَارَتَكَ وَإِذَا رَأَيْتُمْ مَنْ يَنْشُدُ فِيهِ ضَالَّةً فَقُولُوا لاَ رَدَّ اللَّهُ عَلَيْكَ ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ غَرِيبٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ كَرِهُوا الْبَيْعَ وَالشِّرَاءَ فِي الْمَسْجِدِ ‏.‏ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ ‏.‏ وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي الْبَيْعِ وَالشِّرَاءِ فِي الْمَسْجِدِ ‏.

    Narrated Abu Hurairah: That the Messenger of Allah (ﷺ) said: “When you see someone selling or buying in the Masjid then say: ‘May Allah not profit your business.’ And when you see someone announcing about something lost then say: ‘May Allah not return it to you.’” The Hadith of Abu Hurairah is Hasan Gharib. This is acted upon according to some of the people of knowledge. They dislike selling and buying in the Masjid. This is the view of Ahmad and Ishaq. Some of the people of knowledge permitted selling and buying in the Masjid.

    حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الأَعْلَى الصَّنْعَانِيُّ، حَدَّثَنَا الْمُعْتَمِرُ بْنُ سُلَيْمَانَ، قَالَ سَمِعْتُ عَبْدَ الْمَلِكِ، يُحَدِّثُ عَنْ عَبْدِ اللَّهِ بْنِ مَوْهَبٍ، أَنَّ عُثْمَانَ، قَالَ لاِبْنِ عُمَرَ اذْهَبْ فَاقْضِ بَيْنَ النَّاسِ ‏.‏ قَالَ أَوَتُعَافِينِي يَا أَمِيرَ الْمُؤْمِنِينَ ‏.‏ قَالَ وَمَا تَكْرَهُ مِنْ ذَلِكَ وَقَدْ كَانَ أَبُوكَ يَقْضِي قَالَ إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ “‏ مَنْ كَانَ قَاضِيًا فَقَضَى بِالْعَدْلِ فَبِالْحَرِيِّ أَنْ يَنْقَلِبَ مِنْهُ كَفَافًا ‏” ‏ ‏.‏ فَمَا أَرْجُو بَعْدَ ذَلِكَ وَفِي الْحَدِيثِ قِصَّةٌ ‏.‏ وَفِي الْبَابِ عَنْ أَبِي هُرَيْرَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ غَرِيبٌ وَلَيْسَ إِسْنَادُهُ عِنْدِي بِمُتَّصِلٍ ‏.‏ وَعَبْدُ الْمَلِكِ الَّذِي رَوَى عَنْهُ الْمُعْتَمِرُ هَذَا هُوَ عَبْدُ الْمَلِكِ بْنُ أَبِي جَمِيلَةَ ‏.‏

    ‘Abdullah bin Mawhab narrated that ‘Uthman said to Ibn ‘Umar: “Go and judge between the people.” So he said: “Perhaps you can excuse me (from that) O Commander of the Believers!” He said: “Why do you have an aversion for that when your father judged?” He said: “I heard the Messenger of Allah saying: ‘Whoever was a judge and judged with justice, it still would have been better for him to have turned away from it completely.’ What do I want after that?’” (Daif).
