    حَدَّثَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ، حَدَّثَنِي الْحَسَنُ بْنُ بِشْرٍ، حَدَّثَنَا شَرِيكٌ، عَنِ الأَعْمَشِ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، عَنِ ابْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ “‏ الْقُضَاةُ ثَلاَثَةٌ قَاضِيَانِ فِي النَّارِ وَقَاضٍ فِي الْجَنَّةِ رَجُلٌ قَضَى بِغَيْرِ الْحَقِّ فَعَلِمَ ذَاكَ فَذَاكَ فِي النَّارِ وَقَاضٍ لاَ يَعْلَمُ فَأَهْلَكَ حُقُوقَ النَّاسِ فَهُوَ فِي النَّارِ وَقَاضٍ قَضَى بِالْحَقِّ فَذَلِكَ فِي الْجَنَّةِ ‏” ‏ ‏.‏

    [Ibn Buraidah narrated from his father that the Prophet (ﷺ) said: “The judges are three: Two judges that are in the Fire, and a judge that is in Paradise. A man who judges without the truth, and he knows that. This one is in the Fire. One who judges while not knowing, ruining the rights of the people. So he is in the Fire. A judge who judges with the truth, that is the one in Paradise.”] (Daif)

    حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا وَكِيعٌ، عَنْ إِسْرَائِيلَ، عَنْ عَبْدِ الأَعْلَى، عَنْ بِلاَلِ بْنِ أَبِي مُوسَى، عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ مَنْ سَأَلَ الْقَضَاءَ وُكِلَ إِلَى نَفْسِهِ وَمَنْ أُجْبِرَ عَلَيْهِ يُنْزِلُ اللَّهُ عَلَيْهِ مَلَكًا فَيُسَدِّدُهُ ‏” ‏ ‏.‏

    Anas bin Malik narrated that the Messenger of Allah (sallAllahu Alayhi wa sallam) said: “Whoever asks for a position as a judge, then he left on his own. And whoever is forced onto it, Allah sends an angel down to him so that he can be correct.” (Daif)

    حَدَّثَنَا أَبُو كُرَيْبٍ، وَمَحْمُودُ بْنُ غَيْلاَنَ، قَالاَ حَدَّثَنَا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ بَيْعِ الْمُنَابَذَةِ وَالْمُلاَمَسَةِ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَبِي سَعِيدٍ وَابْنِ عُمَرَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَمَعْنَى هَذَا الْحَدِيثِ أَنْ يَقُولَ إِذَا نَبَذْتُ إِلَيْكَ الشَّىْءَ فَقَدْ وَجَبَ الْبَيْعُ بَيْنِي وَبَيْنَكَ ‏.‏ وَالْمُلاَمَسَةُ أَنْ يَقُولَ إِذَا لَمَسْتَ الشَّىْءَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ كَانَ لاَ يَرَى مِنْهُ شَيْئًا مِثْلَ مَا يَكُونُ فِي الْجِرَابِ أَوْ غَيْرِ ذَلِكَ وَإِنَّمَا كَانَ هَذَا مِنْ بُيُوعِ أَهْلِ الْجَاهِلِيَّةِ فَنَهَى عَنْ ذَلِكَ ‏.‏

    Narrated Abu Hurairah: “The Messenger of Allah (ﷺ) prohibited sales of Al-Munabadhah and Al-Mulamasah.” He said: There are narrations on this topic from Abu Sa’eed and Ibn ‘Umar. [Abu ‘Eisa said:] The Hadith is Abu Hurairah is a Hasan Sahih Hadith. And the meaning of (Munabadhah) in this Hadith is when it is said: “When I throw something to you then the sale between you and I is concluded.” And Al-Mulamasah is that he says: “When you touch something then the sale is concluded.” Even if he did not see it at all, like if it was inside of a bag or something else. There are merely sales practices of the people of Jahiliyyah so they were prohibited.

    حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ، أَخْبَرَنَا يَحْيَى بْنُ حَمَّادٍ، عَنْ أَبِي عَوَانَةَ، عَنْ عَبْدِ الأَعْلَى الثَّعْلَبِيِّ، عَنْ بِلاَلِ بْنِ مِرْدَاسٍ الْفَزَارِيِّ، عَنْ خَيْثَمَةَ، وَهُوَ الْبَصْرِيُّ عَنْ أَنَسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ مَنِ ابْتَغَى الْقَضَاءَ وَسَأَلَ فِيهِ شُفَعَاءَ وُكِلَ إِلَى نَفْسِهِ وَمَنْ أُكْرِهَ عَلَيْهِ أَنْزَلَ اللَّهُ عَلَيْهِ مَلَكًا يُسَدِّدُهُ ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ وَهُوَ أَصَحُّ مِنْ حَدِيثِ إِسْرَائِيلَ عَنْ عَبْدِ الأَعْلَى ‏.‏

    Anas narrated that the Prophet (ﷺ) said: “Whoever seeks to be a judge, and asks others to intercede for him with it, then he will be left on his own. And whoever is coerced into it, Allah sends an angel down to him so that he can be correct.” (Daif)

    حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ عَبْدِ اللَّهِ بْنِ كَثِيرٍ، عَنْ أَبِي الْمِنْهَالِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَدِمَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي الثَّمَرِ فَقَالَ ‏ “‏ مَنْ أَسْلَفَ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ ‏” ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنِ ابْنِ أَبِي أَوْفَى وَعَبْدِ الرَّحْمَنِ بْنِ أَبْزَى ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَجَازُوا السَّلَفَ فِي الطَّعَامِ وَالثِّيَابِ وَغَيْرِ ذَلِكَ مِمَّا يُعْرَفُ حَدُّهُ وَصِفَتُهُ وَاخْتَلَفُوا فِي السَّلَمِ فِي الْحَيَوَانِ فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمُ السَّلَمَ فِي الْحَيَوَانِ جَائِزًا ‏.‏ وَهُوَ قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ ‏.‏ وَكَرِهَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمُ السَّلَمَ فِي الْحَيَوَانِ ‏.‏ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَأَهْلِ الْكُوفَةِ ‏.‏ أَبُو الْمِنْهَالِ اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ مُطْعِمٍ ‏.‏

    Narrated Ibn ‘Abbas: “When the Prophet (ﷺ) arrived in Al-Madinah, they were paying in advance for fruits. So he said: ‘Whoever pays in advance, then let him pay in advance for known measurements (of dates), and known weights for a specified period of time.’” He said: There are narrations on this topic from Ibn Abi Awfa and ‘Abdur-Rahman bin Abza. [Abu ‘Eisa said:] The Hadith of Ibn ‘Abbas is a Hasan Sahih Hadith. This is acted upon according to the people of knowledge among the Companions of the Prophet (ﷺ) and others. They allow for advanced payments on food, garments and other things in which the limits and description are known. They differed over delay in delivery of animals. Some of the people of knowledge among the Companions of the Prophet (ﷺ) and others thought that delay in delivery of animals is allowed. This is the view of Ash-Shafi’i, Ahmad and Ishaq. Some of the people of knowledge among the Companions of the Prophet (ﷺ) and others, disliked delay in delivery of animals. This is the saying of Sufyan and the people of Al-Kufah. And Abu Al-Minhal’s (a narrator) name is ‘Abdur-Rahman bin Mut’im.

    حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْجَهْضَمِيُّ، حَدَّثَنَا الْفُضَيْلُ بْنُ سُلَيْمَانَ، عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ مَنْ وَلِيَ الْقَضَاءَ أَوْ جُعِلَ قَاضِيًا بَيْنَ النَّاسِ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ ‏.‏ وَقَدْ رُوِيَ أَيْضًا مِنْ غَيْرِ هَذَا الْوَجْهِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏

    Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “Whoever takes the responsibility of judge, or is appointed as judge between the people, then he has been slaughtered without a knife.”

    حَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ، حَدَّثَنَا عِيسَى بْنُ يُونُسَ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ سُلَيْمَانَ الْيَشْكُرِيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّ نَبِيَّ اللَّهِ صلى الله عليه وسلم قَالَ ‏ “‏ مَنْ كَانَ لَهُ شَرِيكٌ فِي حَائِطٍ فَلاَ يَبِيعُ نَصِيبَهُ مِنْ ذَلِكَ حَتَّى يَعْرِضَهُ عَلَى شَرِيكِهِ ‏” ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ إِسْنَادُهُ لَيْسَ بِمُتَّصِلٍ ‏.‏ سَمِعْتُ مُحَمَّدًا يَقُولُ سُلَيْمَانُ الْيَشْكُرِيُّ يُقَالُ إِنَّهُ مَاتَ فِي حَيَاةِ جَابِرِ بْنِ عَبْدِ اللَّهِ ‏.‏ قَالَ وَلَمْ يَسْمَعْ مِنْهُ قَتَادَةُ وَلاَ أَبُو بِشْرٍ ‏.‏ قَالَ مُحَمَّدٌ وَلاَ نَعْرِفُ لأَحَدٍ مِنْهُمْ سَمَاعًا مِنْ سُلَيْمَانَ الْيَشْكُرِيِّ إِلاَّ أَنْ يَكُونَ عَمْرُو بْنُ دِينَارٍ فَلَعَلَّهُ سَمِعَ مِنْهُ فِي حَيَاةِ جَابِرِ بْنِ عَبْدِ اللَّهِ ‏.‏ قَالَ وَإِنَّمَا يُحَدِّثُ قَتَادَةُ عَنْ صَحِيفَةِ سُلَيْمَانَ الْيَشْكُرِيِّ وَكَانَ لَهُ كِتَابٌ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ‏.‏ حَدَّثَنَا أَبُو بَكْرٍ الْعَطَّارُ عَبْدُ الْقُدُّوسِ قَالَ قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ قَالَ يَحْيَى بْنُ سَعِيدٍ قَالَ سُلَيْمَانُ التَّيْمِيُّ ذَهَبُوا بِصَحِيفَةِ جَابِرِ بْنِ عَبْدِ اللَّهِ إِلَى الْحَسَنِ الْبَصْرِيِّ فَأَخَذَهَا أَوْ قَالَ فَرَوَاهَا وَذَهَبُوا بِهَا إِلَى قَتَادَةَ فَرَوَاهَا وَأَتَوْنِي بِهَا فَلَمْ أَرْوِهَا ‏.‏ يَقُولُ رَدَدْتُهَا ‏.‏

    Narrated Jabir bin ‘Abdullah : That Allah’s Prophet (ﷺ) said: “Whoever has a partner in an orchard, then he is not to sell his share of that until he proposes that to his partner.” [Abu ‘Eisa said:] The chain of this Hadith is not connected. I heard Muhammad bin Isma’il saying: It is said that “Sulaiman Al-Yashkuri died during the lifetime of Jabir bin ‘Abdullah.” He said: “And Qatadah did not hear from him, nor did Abu Bishr.” Muhammad said: “We do not know of any of them hearing from Sulaiman Al-Yashkuri except that ‘Amr bin Dinar possibly heard from his during the lifetome of Jabir bin ‘Abdullah.” He said: “Qatadah only narrated from a writing of Sulaiman Al-Yashkuri, and he has a book from Jabir bin ‘Abdullah.” Abu Bakr Al-‘Attar ‘Abdul Quddus narrates to us, he said: ” ‘Ali bin Al-Madini said: ‘Yahya bin Sa’eed said: “Sulaiman At-Taymi said: ‘They went with the book of Jabir bin ‘Abdullah to Al-Hasan Al-Basri and he took it’ – or he said – ‘and they reported it. Then they took it to Qatadah and reported it, so they gave it to me but I did not report it [he said: ‘I refused it’] This was narrated to us by Abu Bakr Al-‘Attar from ‘Ali bin Al-Madini.

    حَدَّثَنَا الْحُسَيْنُ بْنُ مَهْدِيٍّ الْبَصْرِيُّ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكَمَ فَأَخْطَأَ فَلَهُ أَجْرٌ وَاحِدٌ ‏” ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ عَمْرِو بْنِ الْعَاصِي وَعُقْبَةَ بْنِ عَامِرٍ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ ‏.‏ لاَ نَعْرِفُهُ مِنْ حَدِيثِ سُفْيَانَ الثَّوْرِيِّ عَنْ يَحْيَى بْنِ سَعِيدٍ إِلاَّ مِنْ حَدِيثِ عَبْدِ الرَّزَّاقِ عَنْ مَعْمَرٍ عَنْ سُفْيَانَ الثَّوْرِيِّ ‏.‏

    Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “When the judge passes a judgement in which he strived and was correct, then he receives two rewards. And when he judges and is mistaken, then he receives one reward.”

    حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ، حَدَّثَنَا أَيُّوبُ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَالْمُعَاوَمَةِ وَرَخَّصَ فِي الْعَرَايَا ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

    Narrated Abu Az-Zubair: From Jabir that the Prophet (ﷺ) prohibited Al-Muhaqalah, Al-Muzabanah, Al-Mukhabarah, and Al-Mu’awamah, and he permitted it in the case of Al-‘Araya. [Abu ‘Eisa said:] This Hadith is Hasan Sahih.

    حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا وَكِيعٌ، عَنْ شُعْبَةَ، عَنْ أَبِي عَوْنٍ الثَّقَفِيِّ، عَنِ الْحَارِثِ بْنِ عَمْرٍو، عَنْ رِجَالٍ، مِنْ أَصْحَابِ مُعَاذٍ عَنْ مُعَاذٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم بَعَثَ مُعَاذًا إِلَى الْيَمَنِ فَقَالَ ‏”‏ كَيْفَ تَقْضِي ‏”‏ ‏.‏ فَقَالَ أَقْضِي بِمَا فِي كِتَابِ اللَّهِ ‏.‏ قَالَ ‏”‏ فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللَّهِ ‏”‏ ‏.‏ قَالَ فَبِسُنَّةِ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏.‏ قَالَ ‏”‏ فَإِنْ لَمْ يَكُنْ فِي سُنَّةِ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏”‏ ‏.‏ قَالَ أَجْتَهِدُ رَأْيِي ‏.‏ قَالَ ‏”‏ الْحَمْدُ لِلَّهِ الَّذِي وَفَّقَ رَسُولَ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏”‏ ‏.‏

    Some men who were companions of Mu’adh narrated from Mu’adh that the Messenger of Allah (ﷺ) sent Mu’adh to Yemen, so he (ﷺ) said: “How will you judge?” He said: “I will judge according to what is in Allah’s Book.” He said: “If it is not in Allah’s Book ?” He said: “Then with the Sunnah of the Messenger of Allah (ﷺ).” He said: “If it is not in the Sunnah of Messenger of Allah (ﷺ)?” He said: “I will give in my view.” He said: “All praise is due to Allah, the One Who made the messenger of the Messenger of Allah suitable.”
