    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -نَهَى عَنْ بَيْعِ اَلْمَضَامِينِ, وَالْمَلَاقِيحِ } رَوَاهُ اَلْبَزَّارُ, وَفِي إِسْنَادِ [ هِ ] ضَعْفٌ 1 . 1 – ضعيف. رواه البزار ( 1267 زوائد ). والزيادة من ” أ “، وتحرف فيها: ” ضعف ” إلى ” ضعيف “.

    Narrated Abu Hurairah (RA): The Prophet (صلى الله عليه وسلم) forbade the sale of what is in the womb of a she-camel, and the semen that is in the body of a male-camel. [Reported by al-Bazzar and there is weakness in its Isnad (chain of narrators)].

    عَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ مَنْ أَقَالَ مُسْلِماً بَيْعَتَهُ, أَقَالَهُ اَللَّهُ عَثْرَتَهُ } رَوَاهُ أَبُو دَاوُدَ, وَابْنُ مَاجَهْ, وَصَحَّحَهُ اِبْنُ حِبَّانَ, وَالْحَاكِمُ 1 . 1 – صحيح. رواه أبو داود ( 3460 )، وابن ماجه ( 2199 )، وابن حبان ( 7 / 243 )، والحاكم ( 2 / 45 ).

    Narrated [Abu Hurairah (RA)]: Allah’s Messenger (صلى الله عليه وسلم) said: “Whoever accepts back what he sold to a Muslim, Allah will forgive his fault.” [Reported by Abu Dawud and Ibn Majah. Ibn Hibban and al-Hakim graded it Sahih (authentic)].

    وَعَنْ اِبْنِ عُمَرَ -رَضِيَ اَللَّهُ عَنْهُمَا-, عَنْ رَسُولِ اَللَّهِ – صلى الله عليه وسلم -قَالَ: { إِذَا تَبَايَعَ اَلرَّجُلَانِ, فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعاً, أَوْ يُخَيِّرُ أَحَدُهُمَا اَلْآخَرَ, فَإِنْ خَيَّرَ أَحَدُهُمَا اَلْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدَ وَجَبَ اَلْبَيْعُ, وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا, وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا اَلْبَيْعَ فَقَدْ وَجَبَ اَلْبَيْعُ } مُتَّفَقٌ عَلَيْهِ, وَاللَّفْظُ لِمُسْلِمٍ 1 . 1 – صحيح. رواه البخاري ( 2112 )، ومسلم ( 1531 ) ( 44 ).

    Narrated Ibn ‘Umar (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “Both parties in a business transaction have a right to annul the transaction, so long as they have not separated and remain together; or one of them gives the other the choice (to conclude or annul the transaction); so, if one of them gives the other the choice (to conclude or annul the transaction) and then they make the transaction accordingly, the transaction then becomes binding; or if they separate after having made the transaction and none of them has annulled it, the transaction then becomes binding.” [Agreed upon, and the wording is Muslim’s].

    وَعَنْ عَمْرِو بْنِ شُعَيْبٍ, عَنْ أَبِيهِ, عَنْ جَدِّهِ; أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ: { اَلْبَائِعُ وَالْمُبْتَاعُ بِالْخِيَارِ حَتَّى يَتَفَرَّقَا, إِلَّا أَنْ تَكُونَ صَفْقَةَ 1 خِيَارٍ, وَلَا يَحِلُّ لَهُ أَنْ يُفَارِقَهُ خَشْيَةَ أَنْ يَسْتَقِيلَهُ } رَوَاهُ اَلْخَمْسَةُ إِلَّا اِبْنَ مَاجَهْ, وَاَلدَّارَقُطْنِيُّ, وَابْنُ خُزَيْمَةَ, وَابْنُ اَلْجَارُودِ 2 . 1 – تحرف في ” أ ” إلى: ” صفة “. 2 – حسن. رواه أبو داود ( 3456 )، والنسائي ( 7 / 251 – 252 )، والترمذي ( 1247 )، وأحمد ( 3 / 183 )، والدارقطني ( 3 / 50 / 207 )، وابن الجارود ( 620 )، كلهم من طريق عمرو بن شعيب، به. وقال الترمذي: ” هذا حديث حسن “.

    Narrated ‘Amr bin Shu’aib on his father’s authority from his grandfather (RA): The Prophet (صلى الله عليه وسلم) said: “The two parties (seller and buyer) in a business transaction have a choice (to annul it) until they separated (from one another), unless it is a transaction with the right to annul it attached to it; and it is not allowed for one to separated from the other for fear that he may cancel the deal.” [Reported by al-Khamsah except Ibn Majah. ad-Daraqutni, Ibn Khuzaimah and Ibn al-Jarud also reported it].

    وَفِي رِوَايَةٍ: { حَتَّى يَتَفَرَّقَا مِنْ مَكَانِهِمَا } 1 . 1 – هي رواية الدارقطني، والبيهقي ( 5 / 271 ).

    Another narration has: “till they separated from their place (of transaction).”

    وَعَنِ اِبْنِ عُمَرَ -رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ: ذَكَرَ رَجُلٌ لِلنَّبِيِّ – صلى الله عليه وسلم -أَنَّهُ يُخْدَعُ فِي اَلْبُيُوعِ فَقَالَ: { إِذَا بَايَعْتَ فَقُلْ: لَا خَلَابَةَ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 2117 )، ومسلم ( 1533 ). وفي ” الأصل “: ” بعت ” والمثبت من ” أ ” وهو الموافق لما في ” الصحيحين “. وزاد البخاري ( 2407 ): ” فكان الرجل يقوله “. وفي رواية مسلم: ” فكان إذا بايع يقول: لا خيابة “. قلت: والرجل هو: حبان بن منقذ الأنصاري، وكان يقول ذلك للثغة في لسانه، ففي رواية ابن الجارود ( 567 ): ” عن ابن عمر -رضي الله عنهما-: أن حبان بن منقذ كان سفع في رأسه مأمومة، فثقلت لسانه، وكان يخدع … الحديث.

    Narrated Ibn ‘Umar (RA): A man told Allah’s Messenger (صلى الله عليه وسلم) that he was being deceived (cheated) in business transactions, and he replied, “When you make a purchase say, ‘Deceiving (cheating) is not allowed (i.e. he has the choice to return the goods if he wills).’” [Agreed upon].

    وَقَدْ أَخْرَجَهُ اَلْبُخَارِيُّ ضِمْنَ حَدِيثٍ, وَلَمْ يَسُقْ لَفْظَهُ 1 . 1 – بل رواه البخاري ( 3642 )، وساق لفظه، وإنما هذا من أوهام الحافظ -رحمه الله-.

    al-Bukhari also recorded it within another Hadith but did not report its exact wording.

    وَأَوْرَدَ اَلتِّرْمِذِيُّ لَهُ شَاهِداً: مِنْ حَدِيثِ حَكِيمِ بْنِ حِزَامٍ 1 . 1 – ضعيف. رواه الترمذي ( 1257 )، وأبو داود ( 3386 ) وسنده ضعيف.

    at-Tirmidhi reported a Shahid (supporting narration of similar meaning) for it from the Hadith of Hakim bin Hizam.

    وَعَنِ أَبِي سَعِيدٍ اَلْخُدْرِيِّ – رضى الله عنه – { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -نَهَى عَنْ شِرَاءِ مَا فِي بُطُونِ اَلْأَنْعَامِ حَتَّى تَضَعَ, وَعَنْ بَيْعِ مَا فِي ضُرُوعِهَا, وَعَنْ شِرَاءِ اَلْعَبْدِ وَهُوَ آبِقٌ, وَعَنْ شِرَاءِ اَلْمَغَانِمِ حَتَّى تُقْسَمَ, وَعَنْ شِرَاءِ اَلصَّدَقَاتِ حَتَّى تُقْبَضَ, وَعَنْ ضَرْبَةِ اَلْغَائِصِ } رَوَاهُ اِبْنُ مَاجَهْ, وَالْبَزَّارُ, وَاَلدَّارَقُطْنِيُّ بِإِسْنَادٍ ضَعِيفٍ 1 . 1 – ضعيف. رواه ابن ماجه ( 2196 )، والدارقطني ( 3 / 44 / 15 ).

    Narrated Abu Sa’id al-Khudri (RA): The Prophet (صلى الله عليه وسلم) forbade buying what is in the wombs of domestic animals till they give birth; selling what is in their udders; buying a runaway slave; buying (something from) the spoils of war until they are divided; buying Sadaqat before they are received; and the unknown catch (find) of a diver. [Ibn Majah, al-Bazzar and ad-Daraqutni reported it with a weak chain of narrators].

    وَفِي رِوَايَةٍ: { لَهُ, عَلَّقَهَا } اَلْبُخَارِيُّ: { رَدَّ مَعَهَا صَاعاً مِنْ طَعَامٍ, لَا سَمْرَاءَ } قَالَ اَلْبُخَارِيُّ: وَالتَّمْرُ أَكْثَرُ 1 . 1 – هذه الرواية لمسلم ( 1524 ) ( 25 ) وهي في البخاري ( 4 / 361 / فتح ). وقوله: ” لا تصروا ” نهي عن ترك الشاة والناقة دون حلب حتى يجتمع لبنها ويكثر، فيظن المشتري أن ذلك عادتها. وقوله ” لا سمراء “. أي: لا يتعين السمراء بعينها -وهي: الحنطة- وإنما يصلح الصاع من الطعام الذي هو غالب قوت البلد.

    Another narration by Muslim, which al-Bukhari reported as Mu’allaq (with a broken chain), has: “He must return with it one Sa’ of any grain but wheat.” [al-Bukhari said, “(One Sa’ of) dates is mentioned in more narrations than not].
