    Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back

    وَحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ طَاوُسٍ، عَنْ أَبِيهِ، أَنَّهُ سَمِعَ ابْنَ عُمَرَ، يُسْأَلُ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ حَائِضًا فَقَالَ أَتَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ قَالَ نَعَمْ ‏.‏ قَالَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا فَذَهَبَ عُمَرُ إِلَى النَّبِيِّ صلى الله عليه وسلم فَأَخْبَرَهُ الْخَبَرَ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قَالَ لَمْ أَسْمَعْهُ يَزِيدُ عَلَى ذَلِكَ لأَبِيهِ‏.‏

    Ibn Tawus narrated on the authority of his father that Ibn ‘Umar (Allah be pleased with them) was asked about the person who divorced his wife in the state of menses, whereupon he said: Do you know ‘Abdullah b. Umar? He said: Yes. He said: It was he who divorced his wife jn the state of menses and ‘Umar went to Allah’s Apostle (ﷺ) and gave him this information. and he commanded him that he should take her back; and he (Abu Tawus) said: I did not hear any addition to this (hadith) from my father.

    وَحَدَّثَنِي هَارُونُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا حَجَّاجُ بْنُ مُحَمَّدٍ، قَالَ قَالَ ابْنُ جُرَيْجٍ أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ عَبْدَ الرَّحْمَنِ بْنَ أَيْمَنَ، مَوْلَى عَزَّةَ يَسْأَلُ ابْنَ عُمَرَ وَأَبُو الزُّبَيْرِ يَسْمَعُ ذَلِكَ كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ حَائِضًا فَقَالَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهْىَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ ‏.‏ فَقَالَ لَهُ النَّبِيُّ صلى الله عليه وسلم ‏”‏ لِيُرَاجِعْهَا ‏”‏ ‏.‏ فَرَدَّهَا وَقَالَ ‏”‏ إِذَا طَهَرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ ‏”‏ ‏.‏ قَالَ ابْنُ عُمَرَ وَقَرَأَ النَّبِيُّ صلى الله عليه وسلم يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ فِي قُبُلِ عِدَّتِهِنَّ ‏.‏

    Abu Zubair reported that he heard ‘Abd al-Rahman b. Aiman (the freed slave of ‘Azza) say that he asked Ibn ‘Umar (Allah be pleased with them) and Abu Zubair heard: What is your opinion about the person who divorced his wife in the state of menses? Thereupon he said: Ibn Umar (Allah be pleased with them) divorced his wife during the lifetime of Allah’s Messenger (ﷺ) while she was in the state of menses. Upon this Allah’s Messenger (ﷺ) told him to take her back and so he took her back and he (further) said: When she is pure, then either divorce her or retain her. Ibn ‘Umar (Allah be pleased with them) said that Allah’s Apostle (ﷺ) then recited this verse:” O Apostle, when you divorce women, divorce them at the commencement of their prescribed period” (Ixv 1).

    وَحَدَّثَنِيهِ مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ عَبْدَ الرَّحْمَنِ بْنَ أَيْمَنَ، مَوْلَى عُرْوَةَ يَسْأَلُ ابْنَ عُمَرَ وَأَبُو الزُّبَيْرِ يَسْمَعُ بِمِثْلِ حَدِيثِ حَجَّاجٍ وَفِيهِ بَعْضُ الزِّيَادَةِ ‏.‏ قَالَ مُسْلِمٌ أَخْطَأَ حَيْثُ قَالَ عُرْوَةَ إِنَّمَا هُوَ مَوْلَى عَزَّةَ ‏.‏

    A hadith like this is reported on the same authority (but with this difference that the narrator) ‘Abd al-Rahman b. Aiman (was mentioned) as the freed slave of ‘Urwa (Imam Muslim said: He made a mistake who said that it was ‘Urwa; it was in fact the freed slave of ‘Azza.)

    حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، وَمُحَمَّدُ بْنُ رَافِعٍ، – وَاللَّفْظُ لاِبْنِ رَافِعٍ – قَالَ إِسْحَاقُ أَخْبَرَنَا وَقَالَ ابْنُ رَافِعٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ كَانَ الطَّلاَقُ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَأَبِي بَكْرٍ وَسَنَتَيْنِ مِنْ خِلاَفَةِ عُمَرَ طَلاَقُ الثَّلاَثِ وَاحِدَةً فَقَالَ عُمَرُ بْنُ الْخَطَّابِ إِنَّ النَّاسَ قَدِ اسْتَعْجَلُوا فِي أَمْرٍ قَدْ كَانَتْ لَهُمْ فِيهِ أَنَاةٌ فَلَوْ أَمْضَيْنَاهُ عَلَيْهِمْ ‏.‏ فَأَمْضَاهُ عَلَيْهِمْ ‏.‏

    Ibn ‘Abbas (Allah be pleased with them) reported that the (pronouncement) of three divorces during the lifetime of Allah’s Messenger (ﷺ) and that of Abu Bakr and two years of the caliphate of Umar (Allah be pleased with him) (was treated) as one. But Umar b. Khattab (Allah be pleased with him) said: Verily the people have begun to hasten in the matter in which they are required to observe respite. So if we had imposed this upon them, and he imposed it upon them.

    حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا رَوْحُ بْنُ عُبَادَةَ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، ح وَحَدَّثَنَا ابْنُ رَافِعٍ، – وَاللَّفْظُ لَهُ – حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ طَاوُسٍ، عَنْ أَبِيهِ، أَنَّ أَبَا الصَّهْبَاءِ، قَالَ لاِبْنِ عَبَّاسٍ أَتَعْلَمُ أَنَّمَا كَانَتِ الثَّلاَثُ تُجْعَلُ وَاحِدَةً عَلَى عَهْدِ النَّبِيِّ صلى الله عليه وسلم وَأَبِي بَكْرٍ وَثَلاَثًا مِنْ إِمَارَةِ عُمَرَ ‏.‏ فَقَالَ ابْنُ عَبَّاسٍ نَعَمْ ‏.‏

    Abu Sahba’ said toIbn ‘Abbas (Allah be pleased with them): Do you know that three (divorces) were treated as one during the lifetime of Allah’s Apostle (ﷺ), and that of Abu Bakr, and during three (years) of the caliphate of Umar (Allah be pleased with him)? Ibn Abbas (Allah be pleased with them) said: Yes.

    وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَزُهَيْرُ بْنُ حَرْبٍ، وَابْنُ، نُمَيْرٍ – وَاللَّفْظُ لأَبِي بَكْرٍ – قَالُوا حَدَّثَنَا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، مَوْلَى آلِ طَلْحَةَ عَنْ سَالِمٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ ‏ “‏ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلاً ‏” ‏ ‏.‏

    Ibn ‘Umar (Allah be pleased with them) reported that he divorced his wife while she was in the state of menses. ‘Umar (Allah be pleased with him) made mention of it to Allah’s Apostle (ﷺ) and he said: Command him to take her back, then divorce her when she is pure or she is pregnant.

    Chapter: “Breastfeeding Makes Unlawful What Birth Makes Unlawful.”

    وَحَدَّثَنِي حَرْمَلَةُ بْنُ يَحْيَى، أَخْبَرَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، حَدَّثَنِي ابْنُ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ إِنَّ الْمَرْأَةَ كَالضِّلَعِ إِذَا ذَهَبْتَ تُقِيمُهَا كَسَرْتَهَا وَإِنْ تَرَكْتَهَا اسْتَمْتَعْتَ بِهَا وَفِيهَا عِوَجٌ ‏” ‏ ‏.‏

    Abu Huraira (Allah be pleased with him) reported Allah’s Messenger (ﷺ) as saying: Woman is like a rib. When you attempt to straighten it, you would break it. And if you leave her alone you would benefit by her, and crookedness will remain in her.

    وَحَدَّثَنِي أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ الأَوْدِيُّ، حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ، حَدَّثَنِي سُلَيْمَانُ، – وَهُوَ ابْنُ بِلاَلٍ – حَدَّثَنِي عَبْدُ اللَّهِ بْنُ دِينَارٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَسَأَلَ عُمَرُ عَنْ ذَلِكَ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏ “‏ مُرْهُ فَلْيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ حَيْضَةً أُخْرَى ثُمَّ تَطْهُرَ ثُمَّ يُطَلِّقَ بَعْدُ أَوْ يُمْسِكَ ‏” ‏ ‏.‏

    Ibn ‘Umar (Allah be pleased with them) reported that he divorced his wife while she was in her menses. ‘Umar (Allah be pleased with him) asked Allah’s Apostle (ﷺ) about that, and he said: Command him to take her back until she is pure and then she enters the second menses and then becomes pure. Then either divorce her (finally) or retain her.

    وَحَدَّثَنِيهِ زُهَيْرُ بْنُ حَرْبٍ، وَعَبْدُ بْنُ حُمَيْدٍ، كِلاَهُمَا عَنْ يَعْقُوبَ بْنِ إِبْرَاهِيمَ بْنِ سَعْدٍ، عَنِ ابْنِ أَخِي الزُّهْرِيِّ، عَنْ عَمِّهِ، بِهَذَا الإِسْنَادِ ‏.‏ مِثْلَهُ سَوَاءً ‏.‏

    A hadith like this is reported by another chain of narrators.
