    وَعَنِ اِبْنِ عُمَرَ -رَضِيَ اَللَّهُ عَنْهُمَا-, عَنِ النَّبِيِّ – صلى الله عليه وسلم -قَالَ: { مَنِ اِبْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ, فَثَمَرَتُهَا لِلْبَائِعِ اَلَّذِي بَاعَهَا, إِلَّا أَنْ يَشْتَرِطَ اَلْمُبْتَاعُ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 2379 )، ومسلم ( 1543 ) ( 80 ) وزادا: ومن ابتاع عبدا وله مال فماله للذي باعه إلا أن يشترط المبتاع والتأبير: هو التشقيق والتلقيح.

    Narrated Ibn ‘Umar (RA): The Prophet (صلى الله عليه وسلم) said: “If anyone buys a palm tree after it has been pollinated, the fruits belong to the seller who has sold them unless the buyer makes a condition.” [Agreed upon].

    عَنِ اِبْنِ عَبَّاسٍ -رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ: قَدِمَ اَلنَّبِيُّ – صلى الله عليه وسلم -اَلْمَدِينَةَ, وَهُمْ يُسْلِفُونَ فِي اَلثِّمَارِ اَلسَّنَةَ وَالسَّنَتَيْنِ, فَقَالَ: { مَنْ أَسْلَفَ فِي تَمْرٍ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ, وَوَزْنٍ مَعْلُومٍ, إِلَى أَجَلٍ مَعْلُومٍ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 2239 )، ومسلم ( 1604 )، واللفظ لمسلم.

    Narrated Ibn ‘Abbas (RA): When the Prophet (صلى الله عليه وسلم) came to al-Madinah, they were paying one and two years in advance for fruits. So he (صلى الله عليه وسلم) said: “Those who paid in advance for fruits must do so for a specified measurement and weight, and for a specified time.” [Agreed upon].

    وَلِمُسْلِمٍ: { رَخَّصَ فِي اَلْعَرِيَّةِ يَأْخُذُهَا أَهْلُ اَلْبَيْتِ بِخَرْصِهَا تَمْرًا، يَأْكُلُونَهَا رُطَبًا } 1 . 1 – مسلم ( 1539 ) ( 61 ).

    Muslim has: “He gave permission regarding al-‘Araya (for its sale) in which the household buys its fruit on the basis of a calculation (of what the dates would be when dry), yet they could eat them fresh (from the tree).

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – { أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -رَخَّصَ فِي بَيْعِ اَلْعَرَايَا بِخَرْصِهَا, فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ, أَوْ فِي خَمْسَةِ أَوْسُقٍ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 2190 )، ومسلم ( 1541 ).

    Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) gave permission regarding the sale of al-‘Araya, on the basis of calculation of their amount, for dry dates, on the condition that they be less than five Awsuq, or amounting to five Awsuq. [Agreed upon].

    وَعَنِ اِبْنِ عُمَرَ -رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ: { نَهَى رَسُولُ اَللَّهِ – صلى الله عليه وسلم -عَنْ بَيْعِ اَلثِّمَارِ حَتَّى يَبْدُوَ صَلَاحُهَا, نَهَى اَلْبَائِعَ وَالْمُبْتَاعَ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 2194 )، ومسلم ( 3 / 1165 / رقم 1534 ).

    Narrated Ibn ‘Umar (RA): Allah’s Messenger (صلى الله عليه وسلم) forbade the sale of fruits till they appear to ripe, forbidding it both to the seller and to the buyer. [Agreed upon].

    وَفِي رِوَايَةٍ: وَكَانَ إِذَا سُئِلَ عَنْ صَلَاحِهَا? قَالَ: ” حَتَّى تَذْهَبَ عَاهَتُهُ ” 1 . 1 – الرواية للبخاري ( 1486 )، ولمسلم أيضا ( 3 / 1166 )، والمسئول هو ابن عمر -رضي الله عنهما-.

    A narration has: “When he was asked about (the words): ‘appear to be ripe’?” He (صلى الله عليه وسلم) replied, “Till they were safe from damage or disease.”

    وَعَنْ أَنَسِ بْنِ مَالِكٍ – رضى الله عنه – { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -نَهَى عَنْ بَيْعِ اَلثِّمَارِ حَتَّى تُزْهَى. قِيلَ: وَمَا زَهْوُهَا? قَالَ: ” تَحْمَارُّ وَتَصْفَارُّ } مُتَّفَقٌ عَلَيْهِ , وَاللَّفْظُ لِلْبُخَارِيِّ 1 . 1 – صحيح. رواه البخاري ( 1488 )، ومسلم ( 1555 )، وفي اللفظ الذي ساقه الحافظ، وتخصيصه بالبخاري نظر.

    Narrated Anas bin Malik (RA): The Prophet (صلى الله عليه وسلم) forbade the sale of fruits till they become colorful. He was asked what that meant, he replied, “Till they become reddish and yellowish.” [Agreed upon and the wording is al-Bukhari’s].

    وَعَنْ فَضَالَةَ بْنِ عُبَيْدٍ – رضى الله عنه – قَالَ: { اِشْتَرَيْتُ يَوْمَ خَيْبَرَ قِلَادَةً بِاِثْنَيْ عَشَرَ دِينَاراً, فِيهَا ذَهَبٌ وَخَرَزٌ، فَفَصَلْتُهَا 1 فَوَجَدْتُ فِيهَا أَكْثَرَ مِنْ اِثْنَيْ عَشَرَ دِينَاراً, فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ – صلى الله عليه وسلم -فَقَالَ: ” لَا تُبَاعُ حَتَّى تُفْصَلَ } رَوَاهُ مُسْلِمٌ 2 . 1 – أي: جعلت الذهب وحده والخرز وحده. 2 – صحيح. رواه مسلم ( 1591 ) ( 90 ).

    Narrated Fadala bin ‘Ubaid (RA): I bought a necklace for twelve Dinars at the battle of Khaibar and it contained gold and gems. I considered them separately and found that it was worth more than twelve Dinars. I told the Prophet (صلى الله عليه وسلم) about that and he said, “It must not be sold till the contents are considered separately.” [Reported by Muslim].

    وَعَنْ سَمُرَةَ بْنِ جُنْدُبٍ – رضى الله عنه – { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -نَهَى عَنْ بَيْعِ اَلْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً } رَوَاهُ اَلْخَمْسَةُ, وَصَحَّحَهُ اَلتِّرْمِذِيُّ, وَابْنُ اَلْجَارُودِ 1 . 1 – صحيح بشواهده. رواه أبو داود ( 3356 )، والنسائي ( 7 / 292 )، والترمذي ( 1237 )، وابن ماجه ( 2270 )، وأحمد ( 5 / 12 و 19 و 22 )، وابن الجارود ( 611 ) من طريق الحسن، عن سمرة، به. وقال الترمذي: ” حديث حسن صحيح “. قلت: والحسن مدلس وقد عنعنه، إلا أن له شواهد – يصح بها الحديث – مذكورة ” بالأصل “.

    Narrated Samura bin Jundub (RA): The Prophet (صلى الله عليه وسلم) forbade selling animals for animals when payment was to be made at a later date. [Reported by al-Khamsah. Ibn al-Jarud and at-Tirmidhi graded it Sahih (authentic)].

    وَعَنْ عَبْدِ اَللَّهِ بْنِ عَمْرٍو -رَضِيَ اَللَّهُ عَنْهُمَا-; { أَنَّ رَسُولَ – صلى الله عليه وسلم -أَمَرَهُ أَنْ يُجَهِّزَ جَيْشًا فَنَفِدَتْ اَلْإِبِلُ، فَأَمَرَهُ أَنْ يَأْخُذَ عَلَى قَلَائِصِ اَلصَّدَقَةِ. قَالَ: فَكُنْتُ آخُذُ اَلْبَعِيرَ بِالْبَعِيرَيْنِ إِلَى إِبِلِ اَلصَّدَقَةِ } رَوَاهُ اَلْحَاكِمُ وَالْبَيْهَقِيُّ, وَرِجَالُهُ ثِقَاتٌ 1 . 1 – حسن. رواه الحاكم ( 2 / 56 – 57 )، والبيهقي ( 5 / 287 – 288 ). قلت: والحديث أعل بما لا يقدح، وبيان ذلك ” بالأصل “، ولكن يجدر التنبيه هنا على أن الحديث رواه أبو داود وأحمد وهما بلا شك أعلى ممن ذكر الحافظ. وثانيا: الحديث عند الحاكم من طريق يختلف عن طريقه عند البيهقي.

    Narrated ‘Abdullah bin ‘Amr bin al-‘Aar (RA): The Prophet (صلى الله عليه وسلم) commanded him to equip an army. Then, when the camels were insufficient, he commanded him to keep back the young camels of Sadaqah. He said, “I was taking a camel to be replaced by two when the camels of Sadaqah came.” [Reported by al-Hakim and al-Baihaqi; its narrators are reliable].
