باب اسْتِحْبَابِ النِّكَاحِ لِمَنْ تَاقَتْ نَفْسُهُ إِلَيْهِ وَوَجَدَ مُؤْنَةً وَاشْتِغَالِ مَنْ عَجَزَ عَنِ الْمُؤَنِ بِالصَّوْمِ
Chapter: Marriage is recommended for the one who desires it and can afford it, and the one who cannot afford it should distract himself by fasting
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، وَقُتَيْبَةُ بْنُ سَعِيدٍ، قَالاَ حَدَّثَنَا مَالِكٌ، ح وَحَدَّثَنَا يَحْيَى، بْنُ يَحْيَى – وَاللَّفْظُ لَهُ – قَالَ قُلْتُ لِمَالِكٍ حَدَّثَكَ عَبْدُ اللَّهِ بْنُ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ “ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا ” . قَالَ نَعَمْ .
Ibn ‘Abbas (Allah be pleased with him) reported Allah’s Apostle (ﷺ) as saying: A woman without a husband has more right to her person than her guardian, and a virgin’s consent must be asked from her, and her silence implies her consent.
