باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِجْعَتِهَا
Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back
حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، وَابْنُ، بَشَّارٍ قَالاَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، حَدَّثَنَا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنِ الشَّعْبِيِّ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم فِي الْمُطَلَّقَةِ ثَلاَثًا قَالَ “ لَيْسَ لَهَا سُكْنَى وَلاَ نَفَقَةٌ ” .
Fatima bint Qais (Allah be pleased with her) reported from Allah’s Messenger (ﷺ) that there is no lodging and maintenance allowance for a woman who has been given irrevocable divorce.
