    وَعَنْ اِبْنِ عَبَّاسٍ -رَضِيَ اَللَّهُ عَنْهُمَا- أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ: { يُودَى اَلْمُكَاتَبُ بِقَدْرِ مَا عَتَقَ مِنْهُ دِيَةَ اَلْحُرِّ, وَبِقَدْرِ مَا رَقَّ مِنْهُ دِيَةَ اَلْعَبْدِ } رَوَاهُ أَحْمَدُ, وَأَبُو دَاوُدَ, وَالنَّسَائِيّ ُ 1 . 1 – صحيح. رواه أحمد (1 / 222- 223 و 226 و 260)، وأبو داود (4581)، والنسائي (8 / 46) واللفظ لأحمد.

    Ibn ’Abbas (RAA) narrated that The Messenger of Allah (صلى الله عليه وسلم) said: “The Diyah (Blood money) of a slave who had made an agreement to buy his freedom (Mukatib) and had been killed, is paid at the rate paid for a free man (as a Diyah) as much as he has paid of the amount agreed upon, and at the rate paid for a slave as the remainder is concerned.” Related by Ahmad, Abu Dawud and Au-Nasa’i.

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ ” لَا يَجْزِي وَلَدٌ وَالِدَهُ, إِلَّا أَنْ يَجِدَهُ مَمْلُوكًا فَيُعْتِقَهُ” } رَوَاهُ مُسْلِم ٌ 1 . 1 – صحيح. رواه مسلم ( 1510 ) وزاد: “فيشتريه” بعد قوله: “مملوكا” .

    Abu Hurairah (RAA), narrated that The Messenger of Allah said, “A son cannot ever repay his parents what he owes them, unless he finds them in slavery, then buys them and emancipates them.” Related by Muslim.

    وَعَنْ سَمُرَةَ – رضى الله عنه – أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ: { “مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ, فَهُوَ حُرٌّ” } رَوَاهُ أَحْمَدُ, وَالْأَرْبَعَة ُ 1 . وَرَجَّحَ جَمْعٌ مِنَ الْحُفَّاظِ أَنَّهُ مَوْقُوف ٌ 2 . 1 – صحيح. رواه أحمد ( 5 / 15 و 20 )، وأبو داود ( 3949 )، والترمذي ( 1365 )، والنسائي في “الكبرى” كما في “التحفة” ، وابن ماجه ( 2524 ) من طريق الحسن، عن سمرة. وله شاهد من حديث ابن عمر بإسناد صحيح. رواه ابن ماجه ( 2525 )، وابن الجارود ( 972 ). 2 – وأيضا رجح جمع من الحفاظ أنه مرفوع، منهم: ابن الجارود، والحاكم، وابن حزم، وعبد الحق، وابن القطان. وقال عبد الحق في “الأحكام” كما في نصب الراية ( 3 / 279 ): “الحديث صحيح. .. ولا يضره إرسال من أرسله، ولا وقف من وقفه” .

    Samurah bin Jundub (RAA) narrated that The Messenger of Allah (صلى الله عليه وسلم) said: “Whoever obtains possession of a relative, who is next of kin, that person becomes free.” Related by Ahmad and the four Imams. Some scholars are of the opinion that it is Mawquf (not connected to the Prophet.)

    وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ رَضِيَ اَللَّهُ عَنْهُمَا; { أَنَّ رَجُلاً أَعْتَقَ سِتَّةً مَمْلُوكِينَ لَهُ, عِنْدَ مَوْتِهِ, لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُمْ, فَدَعَا بِهِمْ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -فَجَزَّأَهُمْ أَثْلَاثًا, ثُمَّ أَقْرَعَ بَيْنَهُمْ, فَأَعْتَقَ اِثْنَيْنِ, وَأَرَقَّ أَرْبَعَةً, وَقَالَ لَهُ قَوْلاً شَدِيدًا } رَوَاهُ مُسْلِم ٌ 1 . 1 – صحيح. رواه مسلم ( 1668 ).

    ’Imran bin Husain (RAA) narrated, ‘A man who had no other property emancipated six of his slaves at the time of his death. Allah’s Messenger (صلى الله عليه وسلم)sent for them, and after dividing them into three groups, he cast lots among them, set two of them free and kept four in slavery, and spoke very harshly to the man (who emancipated them).’ Related by Muslim.

    وَعَنْ سَفِينَةَ – رضى الله عنه – { قَالَ: كُنْتُ مَمْلُوكًا لِأُمِّ سَلَمَةَ فَقَالَتْ: أُعْتِقُكَ, وَأَشْتَرِطُ عَلَيْكَ أَنْ تَخْدِمَ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -مَا عِشْتَ } رَوَاهُ أَحْمَدُ, وَأَبُو دَاوُدَ, وَالنَّسَائِيُّ, وَالْحَاكِم ُ 1 . 1 – حسن. رواه أحمد ( 5 / 221 )، وأبو داود ( 3932 )، والنسائي في “الكبرى” ( 3 / 190 – 191 )، والحاكم ( 2 / 213 – 214 ) من طريق سعيد بن جمهان – وهو حسن الحديث – عن سفينة، به. وزادوا إلا أحمد: “قال: قلت: لو أنك لم تشترطي علي ما فارقت رسول الله صلى الله عليه وسلم ما عشت. قال: فأعتقتني، واشترطت علي أن أخدم رسول الله صلى الله عليه وسلم ما عشت” .

    Safinah (RAA) narrated, ‘I was a slave of Umm Salamah and she said, ‘I shall emancipate you, but on the condition that you serve Allah’s Messenger (صلى الله عليه وسلم) as long as you live.’ Related by Ahmad, Abu Dawud, An-Nasa’i and Al-Hakim.

    وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا; أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -قَالَ: { “إِنَّمَا اَلْوَلَاءُ لِمَنْ أَعْتَقَ” } مُتَّفَقٌ عَلَيْهِ فِي حَدِيث ٍ 1 . 1 – تقدم برقم ( 790 ).

    ‘A’ishah (RAA) narrated that The Messenger of Allah (صلى الله عليه وسلم) said: “Wala’ is (legally) for the manumitter.” Agreed upon. It is part of a long Hadith (refer to hadith no. 811).

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ “ثَلَاثَةٌ لَا يُكَلِّمُهُمْ اَللَّهُ يَوْمَ اَلْقِيَامَةِ, وَلَا يَنْظُرُ إِلَيْهِمْ, وَلَا يُزَكِّيهِمْ, وَلَهُمْ عَذَابٌ أَلِيمٌ: رَجُلٌ عَلَى فَضْلِ مَاءٍ بِالْفَلَاةِ, يَمْنَعُهُ مِنْ اِبْنِ اَلسَّبِيلِ; وَرَجُلٌ بَايَعَ رَجُلاً بِسِلْعَةٍ بَعْدَ اَلْعَصْرِ, فَحَلَفَ لَهُ بِاَللَّهِ: لَأَخَذَهَا بِكَذَا وَكَذَا, فَصَدَّقَهُ, وَهُوَ عَلَى غَيْرِ ذَلِكَ; وَرَجُلٌ بَايَعَ إِمَامًا لَا يُبَايِعُهُ إِلَّا لِلدُّنْيَا, فَإِنْ أَعْطَاهُ مِنْهَا, وَفَى, وَإِنْ لَمْ يُعْطِهِ مِنْهَا, لَمْ يَفِ” } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح. رواه البخاري ( 7212 )، ومسلم ( 108 ) والسياق لمسلم.

    Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “There are three to whom Allah will not speak to on the Day of Resurrection, not will He look at them, nor will He purify them, and they will have a painful punishment. (1) A man at a place with excess water in the desert and who withholds it from the travelers. (2) A man who sold a commodity to another person in the afternoon (or after the ‘Asr prayer) and swore to him by Allah that he had bought it at such and such price and he (the buyer) believed him yet that was not the case. (3) And a man who pledged allegiance to an Imam only for the sake of the world (material gains). Hence, if the Imam bestowed on him something out of that (i.e. worldly riches) he stood by his pledge of allegiance, and if he did not give him, he did not fulfill the pledge of allegiance.” [Agreed upon].

    وَعَنْ جَابِرٍ – رضى الله عنه – { أَنَّ رَجُلَيْنِ اِخْتَصَمَا فِي نَاقَةٍ, فَقَالَ كُلُّ وَاحِدٍ مِنْهُمَ ا 1 نُتِجَتْ عِنْدِي, وَأَقَامَا بَيِّنَةً, فَقَضَى بِهَا رَسُولُ اَللَّهِ – صلى الله عليه وسلم -لِمَنْ هِيَ فِي يَدِهِ } 2 . 1 – وقع في “أ”: فقال كل منهما. 2 – ضعيف. رواه الدارقطني ( 4 / 209 ) وقال الحافظ في “التلخيص” ( 4 / 210 ): “إسناده ضعيف”.

    Narrated Jabir (RA): Two men disputed about a she-camel. Then, each of them said: this she-camel was born at my place, and each of them brought a proof (that it was his animal). Allah’s Messenger (صلى الله عليه وسلم) then ruled that it be taken by the one who had it in his possession.

    وَعَنِ ابْنِ عُمَرَ رَضِيَ اَللَّهُ عَنْهُمَا; { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -رَدَّ اَلْيَمِينَ عَلَى طَالِبِ اَلْحَقِّ } رَوَاهُمَا اَلدَّارَقُطْنِيُّ, وَفِي إِسْنَادِهِمَا ضَعْف ٌ 1 . 1 – ضعيف. رواه الدارقطني ( 4 / 213 ). وقال الذهبي في “التلخيص” متعقبا الحاكم ( 4 / 100 ): “أخشى أن يكون الحديث باطلا” .

    Narrated Ibn ‘Umar (RA): The Prophet (صلى الله عليه وسلم) re-directed al-Yamin (the oath to be sword by the defendant) to the one making the claim to some right. [ad-Daraqutni reported the two aforesaid Ahadith, and there is weakness in their chain of narrators].

    وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا { قَالَتْ: دَخَلَ عَلَِيَّ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -ذَاتَ يَوْمٍ مَسْرُورًا, تَبْرُقُ أَسَارِيرُ وَجْهِهِ. فَقَالَ: “أَلَمْ تَرَيْ إِلَى مُجَزِّزٍ اَلْمُدْلِجِيِّ ? نَظَرَ آنِفًا إِلَى زَيْدِ بْنِ حَارِثَةَ, وَأُسَامَةَ بْنِ زَيْدٍ, فَقَالَ: ” هَذِهِ أَقْدَامٌ بَعْضُهَا مِنْ بَعْضٍ” } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح. رواه البخاري ( 6770 )، ومسلم ( 1459 ).

    Narrated ‘Aishah (RA): One day the Prophet (صلى الله عليه وسلم) came to me overjoyed, his face shining (from happiness) and said, “Did you not see that Mujazziz al-Mudliji (a physiognomist) looked at Zaid bin Harithah and Usama bin Zaid, and then said, ‘These feet (of Zaid and Usama) are related to one another.’” [Agreed upon].
