    عَنْ اَلْمِسْوَرِ بْنِ مَخْرَمَةَ – رضى الله عنه – { أَنَّ سُبَيْعَةَ الْأَسْلَمِيَّةَ -رَضِيَ اَللَّهُ عَنْهَا- نُفِسَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ, فَجَاءَتْ اَلنَّبِيَّ – صلى الله عليه وسلم -فَاسْتَأْذَنَتْهُ أَنْ تَنْكِحَ, فَأَذِنَ لَهَا, فَنَكَحَتْ. } رَوَاهُ اَلْبُخَارِيُّ 1 1 – صحيح. رواه البخاري (5320).

    Narrated al-Miswar bin Makhramah (RA): Some nights after her husband’s death, Subai’ah al-Aslamiyah (RA) gave birth to a child. Then she went to the Prophet (صلى الله عليه وسلم) and asked permission to marry. He gave her permission and she married. [Reported by al-Bukhari].

    وَأَصْلُهُ فِي ” اَلصَّحِيحَيْنِ ” 1 . 1 – روى البخاري ( 5318 )، ومسلم ( 1485 )، عن أم سلمة زوج النبي صلى الله عليه وسلم؛ أن امرأة من أسلم يقال لها سبيعة، كانت تحت زوجها، توفي عنها وهي حبلى، فخطبها أبو السنابل بن بعكك، فأبت أن تنكحه، فقال: والله ما يصلح أن تنكحيه حتى تعتدي آخر الأجلين، فمكثت قريبا من عشر ليال، ثم جاءت النبي صلى الله عليه وسلم فقال: ” انكحي “. واللفظ للبخاري. وروى أيضا البخاري ( 5319 )، ومسلم ( 1484 )، وعن سبيعة نفسها أنها سألت النبي صلى الله عليه وسلم؟ فقالت: أفتاني إذا وضعت أن أنكح. واللفظ للبخاري. ولفظ مسلم: فأفتاني بأني قد حللت حين وضعت حملي. وأمرني بالتزوج إن بدا لي.

    Its basic meaning is found in the two Sahih books of al-Bukhari and Muslim.

    وَفِي لَفْظٍ: { أَنَّهَا وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَرْبَعِينَ لَيْلَةً 1 } . 1 – هذا اللفظ للبخاري ( 4909 ) من حديث أم سلمة السابق.

    A wording has: “She gave birth to a child after forty nights of her husband’s death.”

    وَفِي لَفْظٍ لِمُسْلِمٍ, قَالَ اَلزُّهْرِيُّ: { وَلَا أَرَى بَأْسًا أَنْ تَزَوَّجَ وَهِيَ فِي دَمِهَا, غَيْرَ أَنَّهُ لَا يَقْرَبُهَا زَوْجُهَا حتَّى تَطْهُرَ 1 } . 1 – مسلم ( 2 / 1122 ).

    A wording by Muslim has: az-Zuhri said, “I think there is no harm if she marries when she is still bleeding (due to child-birth), but her husband should not go near her till she is purified.”

    وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا قَالَتْ: { أُمِرَتْ بَرِيرَةُ أَنْ تَعْتَدَّ بِثَلَاثِ حِيَضٍ 1 } . رَوَاهُ اِبْنُ مَاجَهْ, وَرُوَاتُهُ ثِقَاتٌ, لَكِنَّهُ مَعْلُولٌ 2 . 1 – هذا اللفظ في ” الأصل ” و ” السنن “، وفي ” أ ” ” حيضات “. وكتب على الهامش من نسخة أخرى: ” حيض “. 2 – صحيح. رواه ابن ماجه ( 2077 )، وصححه البوصيري في ” الزوائد “.

    Narrated ‘Aishah (RA): Barirah was ordered to wait till three menstrual periods of hers have passed (before she could remarry). [Reported by Ibn Majah. Its narrators are reliable, but it is Ma’lul (having a hidden defect)].

    وَعَنْ اَلشَّعْبِيِّ, عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ, { عَنِ اَلنَّبِيِّ – صلى الله عليه وسلم –فِي اَلْمُطَلَّقَةِ ثَلَاثًا-: “لَيْسَ لَهَا سُكْنَى وَلَا نَفَقَةٌ” } رَوَاهُ مُسْلِمٌ 1 . 1 – صحيح. رواه مسلم (1480) (44).

    Narrated ash-Sha’bi from Fatimah (RA) daughter of Qais on the authority of the Prophet (صلى الله عليه وسلم) regarding a woman who was divorced by three pronouncements: “She has no right to accommodation or maintenance.” [Reported by Muslim].

    وَعَنِ اِبْنِ عُمَرَ أَيْضًا { أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -قَالَ لِلْمُتَلَاعِنَيْنِ: “حِسَابُكُمَا عَلَى اَللَّهِ تَعَالَى, أَحَدُكُمَا كَاذِبٌ, لَا سَبِيلَ لَكَ عَلَيْهَا” قَالَ: يَا رَسُولَ اَللَّهِ! مَالِي? قَالَ: “إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا, فَهُوَ بِمَا اِسْتَحْلَلْتَ مِنْ فَرْجِهَا, وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا, فَذَاكَ أَبْعَدُ لَكَ مِنْهَا” } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح. رواه البخاري (5350 )، ومسلم (1493) (5) وهو إحدى روايات الحديث السابق.

    Narrated [Ibn ‘Umar (RA)]: Allah’s Messenger (صلى الله عليه وسلم) said to the two who were invoking curses regarding one another, “Your reckoning is in Allah’s Hands for one of you is lying. You cannot remarry her.” He (the man) said: “O Allah’s Messenger, what about my property (dowry)?” He replied, “If you have spoken the truth, it is the price of your having had the right of intercourse with her, and if you have lied against her, it is even more remote for you (to get it back) from her.” [Agreed upon].

    وَعَنِ أَنَسٍ, أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ: { أَبْصِرُوهَا, فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا فَهُوَ لِزَوْجِهَا, وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا, فَهُوَ اَلَّذِي رَمَاهَا بِهِ } مُتَّفَقٌ عَلَيْه ِ 1 1 – صحيح. وإن كان الحافظ – رحمه الله- وهم في عزوه، وتصرف في لفظه! فالحديث لم يروه البخاري. وإنما رواه مسلم (1496). ولفظه: من طريق محمد بن سيرين قال: سألت أنس بن مالك، وأنا أرى أن عنده منه علما. فقال: إن هلال بن أمية قذف امرأته بشريك بن سحماء، وكان أخا البراء بن مالك لأمه. وكان أول رجل لاعن في الإسلام. قال: فلاعنها. فقال رسول الله صلى الله عليه وسلم: “أبصروها. فإن جاءت به أبيض سبطا قضيء العينين، فهو لهلال بن أمية. وإن جاءت به أكحل جعدا حمش الساقين، فهو لشريك بن سحماء”. قال: فأنبئت أنها جاءت به أكحل، جعدا، حمش الساقين.

    Narrated Anas (RA): The Prophet (صلى الله عليه وسلم) said: “Observe her, and if she gives birth to a child which is white complexioned with dark hair, her husband would be its father. But if she gives birth to a child with eyes looking as if they have antimony (Kuhl) in them and curled hair, the man whom her husband charged her with committing adultery is its father.” [Agreed upon].

    وَعَنِ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا; { أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -أَمَرَ رَجُلاً أَنْ يَضَعَ يَدَهُ عِنْدَ اَلْخَامِسَةِ عَلَى فِيهِ, وَقَالَ: “إِنَّهَا مُوجِبَةٌ” } رَوَاهُ أَبُو دَاوُدَ, وَالنَّسَائِيُّ, وَرِجَالُهُ ثِقَات ٌ 1 . 1 – حسن. رواه أبو داود (2255)، والنسائي (657).

    Narrated Ibn Abbas (RA): Allah’s Messenger (صلى الله عليه وسلم) ordered a man to put his hand on his mouth when he came to the fifth pronouncement and said, “It would be the deciding one.” [Reported by Abu Dawud and an-Nasa’i. It’s narrators are reliable].

    وَعَنْ سَهْلِ بْنِ سَعْدٍ -فِي قِصَّةِ اَلْمُتَلَاعِنَيْنِ- قَالَ: { فَلَمَّا فَرَغَا مِنْ تَلَاعُنِهِمَا قَالَ: كَذَبْتُ عَلَيْهَا يَا رَسُولَ اَللَّهِ! إِنْ أَمْسَكْتُهَا, فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -} مُتَّفَقٌ عَلَيْهِ . 1 . 1 – صحيح. رواه البخاري (5308) ومسلم (1492) (1).

    Narrated Sahl bin Sa’d (RA) concerning the story of the two (husband and wife) who invoked curses regarding one another: When they finished invoking curses regarding one another the man said, “I shall have lied against her, O Allah’s Messenger, if I keep her (as a wife).” He, then, pronounced her divorce three times, even before Allah’s Messenger (صلى الله عليه وسلم) commanded him to do so. [Agreed upon].
