    وَعَنْ جَابِرٍ – رضى الله عنه – قَالَ: { طُلِّقَتْ خَالَتِي, فَأَرَادَتْ أَنْ تَجُدَّ نَخْلَهَا فَزَجَرَهَا رَجُلٌ أَنْ تَخْرُجَ, فَأَتَتْ اَلنَّبِيَّ – صلى الله عليه وسلم -فَقَالَ: بَلْ جُدِّي نَخْلَكِ, فَإِنَّكَ عَسَى أَنْ تَصَدَّقِي, أَوْ تَفْعَلِي مَعْرُوفًا } رَوَاهُ مُسْلِمٌ 1 1110- وَعَنْ فُرَيْعَةَ بِنْتِ مَالِكٍ; { أَنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْبُدٍ 2 لَهُ فَقَتَلُوهُ. قَالَتْ: فَسَأَلْتُ اَلنَّبِيَّ – صلى الله عليه وسلم -أَنْ أَرْجِعَ إِلَى أَهْلِي; فَإِنَّ زَوْجِي لَمْ يَتْرُكْ لِي مَسْكَنًا يَمْلِكُهُ وَلَا نَفَقَةً, فَقَالَ: “نَعَمْ”. فَلَمَّا كُنْتُ فِي اَلْحُجْرَةِ نَادَانِي, فَقَالَ: ” اُمْكُثِي فِي بَيْتِكَ حَتَّى يَبْلُغَ اَلْكِتَابُ أَجَلَهُ”. قَالَتْ: فَاعْتَدَدْتُ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا, قَالَتْ: فَقَضَى بِهِ بَعْدَ ذَلِكَ عُثْمَانُ } أَخْرَجَهُ أَحْمَدُ, وَالْأَرْبَعَةُ, وَصَحَّحَهُ اَلتِّرْمِذِيُّ, والذُّهْلِيُّ, وَابْنُ حِبَّانَ, وَالْحَاكِمُ وَغَيْرُهُمْ 3 . 1 – صحيح. رواه مسلم (1483). 2 – في “أ”: “عبد” وهو خطأ ناسخ. والله أعلم. 3 – حسن. رواه أحمد (6 /370 و 420 – 421)، وأبو داود (2300)، والنسائي (699)، والترمذي (1204)، وابن ماجه (2031)، وابن حبان (1331 و 1332)، والحاكم (208). وقال الترمذي: “حديث حسن صحيح”. وتصحيح الذهلي نقله الحاكم، وأما تضعيف ابن حزم له (10 /302) فمردود عليه كما تجده بالأصل.

    Narrated Jabir (RA): My maternal aunt was divorced and wanted to cut down fruit from her paml-trees. A man forbade her to go out, so she went to the Prophet (صلى الله عليه وسلم) and he said, “Certainly, cut down fruit from your palm-trees, for perhaps you have give Sadaqah (charity) or do an act of kindness.” [Reported by Muslim]. 1121. Narrated Furai’ah, daughter of Malik: Her husband had gone out in search of some slaves of his and they killed him. She said, “I asked Allah’s Messenger (صلى الله عليه وسلم) to be allowed to return to my family, for my husband had not left for me a house which belonged to him, nor had he left me maintenance.” He then said, “Yes, (I agree),” but when I was in the courtyard, he called me and said, “Stay in your house till the prescribed period expires.” She said, “I observed the period in it for four months and ten days.” She said, “Afterwards ‘Uthman gave judgements in accordance with that.” [Ahmad an al-Arba’a reported it. at-Tirmidhi, adh-Dhuhli, Ibn Hibban, al-Hakim and others graded it Sahih (authentic)].

    وَعَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ: { يَا رَسُولَ اَللَّهِ! إِنَّ زَوْجِي طَلَّقَنِي ثَلَاثًا, وَأَخَافُ أَنْ يُقْتَحَمَ عَلَيَّ, قَالَ: فَأَمَرَهَا, فَتَحَوَّلَتْ. } رَوَاهُ مُسْلِمٌ 1 . 1 – صحيح. رواه مسلم (14182).

    Narrated Fatimah (RA) daughter of Qais: I said, “O Allah’s Messenger, my husband has divorced me by three pronouncements (of divorce) and I am afraid that I may get broken into. Hence, he commanded her, and she moved (to another house).” [Reported by Muslim].

    وَعَنْ عَمْرِو بْنِ الْعَاصِ قَالَ: { لَا تُلْبِسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا, عِدَّةُ أُمِّ اَلْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا } . رَوَاهُ أَحْمَدُ, وَأَبُو دَاوُدَ, وَابْنُ مَاجَهْ, وَصَحَّحَهُ اَلْحَاكِمُ, وَأَعَلَّهُ اَلدَّارَقُطْنِيُّ بِالِانْقِطَاعِ 1 . 1 – ضعيف. رواه أحمد (403)، وأبو داود (2308)، وابن ماجه (2083)، والحاكم (208) من طريق قبيصة بن ذؤيب، عن عمرو، به. وعلته قول الدارقطني في “السنن” (3 /309): “قبيصة لم يسمع من عمرو”. قلت: وروي موقوفا وصحح الوقف غير واحد، وأيضا استنكره الإمام أحمد.

    Narrated ‘Amr bin al-‘Aas (RA): “Do not confuse us about our Prophet’s Sunnah: The period that a slave-woman, whose master dies, and she has begotten a child from him must wait for, is four months and ten days.” [Reported by Ahmad, Abu Dawud and Ibn Majah. al-Hakim graded it Sahih (authentic), but ad-Daraqutni considered it defective due to Inqita’ (broken link)].

    وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا قَالَتْ: { إِنَّمَا اَلْأَقْرَاءُ; اَلْأَطْهَارُ } . أَخْرَجَهُ مَالِكٌ فِي قِصَّةٍ بِسَنَدٍ صَحِيحٍ 1 . 1 – صحيح. رواه مالك في “الموطأ” (2 /576 – 577 /54).

    Narrated ‘Aishah (RA): al-Aqra’ is the period of a woman’s purity (which occurs between two menses). [Malik, Ahmad and an-Nasa’i reported it in the course of a story with a Sahih (authentic) chain of narrators].

    وَعَنِ اِبْنِ عُمَرَ رَضِيَ اَللَّهُ عَنْهُمَا قَالَ: { طَلَاقُ اَلْأَمَةِ تَطْلِيقَتَانِ, وَعِدَّتُهَا حَيْضَتَانِ } رَوَاهُ اَلدَّارَقُطْنِيُّ 1 . 1 – صحيح موقوفا. رواه الدارقطني (4 /38)، موقوفا من طريق سالم ونافع، عن ابن عمر وصححه.

    Narrated Ibn ‘Umar (RA): The divorce of a slave-woman occurs by saying it (the divorce word) twice, and her ‘Iddah (waiting period) is two menses. [Reported by ad-Daraqutni].

    وَأَخْرَجَهُ مَرْفُوعًا وَضَعَّفَهُ 1 . 1 – منكر. رواه ابن ماجه (2079)، والدارقطني (4 /38)، من طريق عمر بن شبيب، عن عبد الله بن عيسى، عن عطية، عن ابن عمر، مرفوعا. وقال الدارقطني: “حديث عبد الله بن عيسى، عن عطية، عن ابن عمر، عن النبي صلى الله عليه وسلم منكر غير ثابت من وجهين، أحدهما: أن عطية ضعيف، وسالم ونافع أثبت منه وأصح رواية. والوجه الآخر: أن عمر بن شبيب ضعيف الحديث لا يحتج بروايته. والله أعلم”.

    He reported it as Marfu’ (a saying of the Prophet) and graded it Da’if (weak).

    وَعَنْ أُمِّ عَطِيَّةَ; أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -قَالَ: { لَا تَحِدَّ اِمْرَأَةٌ عَلَى مَيِّتٍ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا, وَلَا تَلْبَسْ ثَوْبًا مَصْبُوغًا, إِلَّا ثَوْبَ عَصْبٍ, وَلَا تَكْتَحِلْ, وَلَا تَمَسَّ طِيبًا, إِلَّا إِذَا طَهُرَتْ نُبْذَةً مِنْ قُسْطٍ أَوْ أَظْفَارٍ. } مُتَّفَقٌ عَلَيْهِ, وَهَذَا لَفْظُ مُسْلِمٍ 1 1 – صحيح. رواه البخاري (313)، ومسلم (2127/ رقم66).

    Narrated Umm ‘Atiyah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “A woman must not observe her mourning for more than three nights for the one who has died, except for the four months and ten days in the case of her husband; and she must not wear a dyed garment except one of the type made of ‘Ash (dyed yarn) or apply Kuhl (antimony), or apply perfume, except for a little Qust or Azfar, when she has been purified after her menstruation.” [Agreed upon. The wording being of Muslim].

    وَعَنْ عُمَرَ – رضى الله عنه – قَالَ: { مَنْ أَقَرَّ بِوَلَدٍ طَرْفَةَ عَيْنٍ, فَلَيْسَ لَهُ أَنْ يَنْفِيَهُ } . أَخْرَجَهُ اَلْبَيْهَقِيُّ, وَهُوَ حَسَنٌ مَوْقُوف ٌ 1 . 1 – ضعيف. رواه البيهقي في “الكبرى” (7 /411 – 412) وفي سنده مجالد بن سعيد ضعفه غير واحد، وقال الحافظ نفسه في “التقريب” : “ليس بالقوي، وقد تغير في آخر عمره”.

    Narrated ‘Umar (RA): If anyone acknowledges that he is the father of his child just for the blinking of an eye, he has no right to disown it.” [al-Baihaqi reported it. The Hadith is Hasan (good) and Mawquf (saying of a Companion)].

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – { أَنَّ رَجُلًا قَالَ: يَا رَسُولَ اَللَّهِ! إِنَّ اِمْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ? قَالَ: “هَلْ لَكَ مِنْ إِبِلٍ?” قَالَ: نَعَمْ. قَالَ: “فَمَا أَلْوَانُهَا?” قَالَ: حُمْرٌ. قَالَ: “هَلْ فِيهَا مَنْ أَوْرَقَ?”, قَالَ: نَعَمْ. قَالَ: “فَأَنَّى ذَلِكَ?”, قَالَ: لَعَلَّهُ نَزَعَهُ عِرْقٌ. قَالَ: “فَلَعَلَّ اِبْنَكَ هَذَا نَزَعَهُ عِرْقٌ”. } مُتَّفَقٌ عَلَيْهِ . 1 1 – صحيح. رواه البخاري (5305)، ومسلم (1500).

    Narrated Abu Hurairah (RA): A man said, “O Allah’s Messenger, my wife has given birth to a black son.” He asked, “Have you any camels?” He replied, “Yes.” He asked, “What is their color?” He replied, “They are red.” He asked, “Is there a dusky (dark) one among them?” He replied, “Yes.” He asked, “How has that come about?” He replied, “It is perhaps a strain to which it has reverted (i.e. heredity).” He said, “It is perhaps a strain to which this son of yours has reverted.” [Agreed upon].

    وَفِي رِوَايَةٍ لِمُسْلِمٍ: { وَهُوَ يُعَرِّضُ بِأَنْ يَنْفِيَهُ } , وَقَالَ فِي آخِرِهِ: { وَلَمْ يُرَخِّصْ لَهُ فِي اَلِانْتِفَاءِ مِنْهُ } 1 . 1 – هي في مسلم برقم (19).

    Muslim concluded the Hadith as follows: “He did not permit him to disown him”
