وَعَنِ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا, عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ: { لَا يَخْلُوَنَّ رَجُلٌ بِاِمْرَأَةٍ, إِلَّا مَعَ ذِي مَحْرَمٍ. } أَخْرَجَهُ اَلْبُخَارِيُّ 1 . 1 – صحيح. رواه البخاري (5233)، وهو لمسلم أيضا (1341) إلا أنه قال: “إلا ومعها ذو محرم”.

Narrated Ibn ‘Abbas (RA): The Prophet (صلى الله عليه وسلم) said: “A man must not be alone with a woman except in the presence of a Mahram.” [al-Bukhari reported it].

وَعَنْ أَبِي سَعِيدٍ – رضى الله عنه – أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ فِي سَبَايَا أَوْطَاسٍ: { لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ, وَلَا غَيْرُ ذَاتِ حَمْلٍ حَتَّى تَحِيضَ حَيْضَةً } أَخْرَجَهُ أَبُو دَاوُدَ, وَصَحَّحَهُ اَلْحَاكِمُ 1 . 1 – صحيح. رواه أبو داود (2157)، والحاكم (295) وهو وإن كان في سنده شريك، وهو سيء الحفظ، إلا أن له شواهد تدل على صحته، وعلى أنه قد حفظه. من هذه الشواهد حديث ابن عباس التالي، وحديث رويفع السابق (1116)، وبقية الشواهد مخرجة في “الأصل”.

Narrated Abu Sa’id (RA)” The Prophet (صلى الله عليه وسلم) said in regard to the captives taken at Autas, “There must be no intercourse with a pregnant woman till she gives birth, or with one who is not pregnant till she has had one menstrual period.” [Abu Dawud reported it, and al-Hakim graded it Sahih (authentic)].

وَلَهُ شَاهِدٌ: عَنْ اِبْنِ عَبَّاسٍ فِي اَلدَّارَقُطْنِيِّ 1 . 1 – صحيح بشواهده ورواه الدارقطني (357) بسند حسن. ولفظه: “نهى رسول الله صلى الله عليه وسلم أن توطأ حامل حتى تضع، أو حائل حتى تحيض”.

The aforesaid Hadith has a supporting narration from Ibn ‘Abbas (RA) reported by ad-Daraqutni.

وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ: { اَلْوَلَدُ لِلْفِرَاشِ, وَلِلْعَاهِرِ اَلْحَجَرُ. } مُتَّفَقٌ عَلَيْهِ مِنْ حَدِيثِهِ 1 . 1 – صحيح. رواه البخاري (6818)، ومسلم (1458).

Narrated Abu Hurairah (RA): The Prophet (صلى الله عليه وسلم) said: “The child (born out of wedlock) belongs to the one on whose bed it is born, and stoning to death is for the fornicator.” [Agreed upon, regarding Abu Hurairah’s Hadith].

وَمِنْ حَدِيثِ عَائِشَةَ فِي قِصَّةٍ 1 . 1 – صحيح. رواه البخاري (6817)، ومسلم (1457).

وَعَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ: { يَا رَسُولَ اَللَّهِ! إِنَّ زَوْجِي طَلَّقَنِي ثَلَاثًا, وَأَخَافُ أَنْ يُقْتَحَمَ عَلَيَّ, قَالَ: فَأَمَرَهَا, فَتَحَوَّلَتْ. } رَوَاهُ مُسْلِمٌ 1 . 1 – صحيح. رواه مسلم (14182).

Narrated Fatimah (RA) daughter of Qais: I said, “O Allah’s Messenger, my husband has divorced me by three pronouncements (of divorce) and I am afraid that I may get broken into. Hence, he commanded her, and she moved (to another house).” [Reported by Muslim].

وَعَنْ عَمْرِو بْنِ الْعَاصِ قَالَ: { لَا تُلْبِسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا, عِدَّةُ أُمِّ اَلْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا } . رَوَاهُ أَحْمَدُ, وَأَبُو دَاوُدَ, وَابْنُ مَاجَهْ, وَصَحَّحَهُ اَلْحَاكِمُ, وَأَعَلَّهُ اَلدَّارَقُطْنِيُّ بِالِانْقِطَاعِ 1 . 1 – ضعيف. رواه أحمد (403)، وأبو داود (2308)، وابن ماجه (2083)، والحاكم (208) من طريق قبيصة بن ذؤيب، عن عمرو، به. وعلته قول الدارقطني في “السنن” (3 /309): “قبيصة لم يسمع من عمرو”. قلت: وروي موقوفا وصحح الوقف غير واحد، وأيضا استنكره الإمام أحمد.

Narrated ‘Amr bin al-‘Aas (RA): “Do not confuse us about our Prophet’s Sunnah: The period that a slave-woman, whose master dies, and she has begotten a child from him must wait for, is four months and ten days.” [Reported by Ahmad, Abu Dawud and Ibn Majah. al-Hakim graded it Sahih (authentic), but ad-Daraqutni considered it defective due to Inqita’ (broken link)].

وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا قَالَتْ: { إِنَّمَا اَلْأَقْرَاءُ; اَلْأَطْهَارُ } . أَخْرَجَهُ مَالِكٌ فِي قِصَّةٍ بِسَنَدٍ صَحِيحٍ 1 . 1 – صحيح. رواه مالك في “الموطأ” (2 /576 – 577 /54).

Narrated ‘Aishah (RA): al-Aqra’ is the period of a woman’s purity (which occurs between two menses). [Malik, Ahmad and an-Nasa’i reported it in the course of a story with a Sahih (authentic) chain of narrators].
