وَعَنِ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا قَالَ: { كَانَ إِيلَاءُ اَلْجَاهِلِيَّةِ اَلسَّنَةَ وَالسَّنَتَيْنِ, فَوَقَّتَ اَللَّهُ أَرْبَعَةَ أَشْهُرٍ, فَإِنْ كَانَ أَقَلَّ مِنْ أَرْبَعَةِ أَشْهُرٍ, فَلَيْسَ بِإِيلَاءٍ } أَخْرَجَهُ اَلْبَيْهَقِيُّ . 1 . 1 – صحيح. رواه البيهقي (7 /381).

Narrated Ibn ‘Abbas (RA): The swearing to stay away from one’s wife in al-Jahiliyyah era was for one or two years. Then, Allah appointed a period of four months for it. So, if it is less than four months, it is not swearing to stay away from one’s wife. [al-Baihaqi reported it]

وَعَنْهُ رَضِيَ اَللَّهُ تَعَالَى عَنْهُمَا; { أَنَّ رَجُلًا ظَاهَرَ مِنِ اِمْرَأَتِهِ, ثُمَّ وَقَعَ عَلَيْهَا, فَأَتَى اَلنَّبِيَّ – صلى الله عليه وسلم -فَقَالَ: إِنِّي وَقَعْتُ عَلَيْهَا قَبْلَ أَنْ أُكَفِّرَ, قَالَ: “فَلَا تَقْرَبْهَا حَتَّى تَفْعَلَ مَا أَمَرَكَ اَللَّهُ” . } رَوَاهُ اَلْأَرْبَعَةُ وَصَحَّحَهُ اَلتِّرْمِذِيُّ, وَرَجَّحَ النَّسَائِيُّ إِرْسَالَه ُ 1 . 1 – صحيح. رواه أبو داود (2223)، والنسائي (667)، والترمذي (1199)، وابن ماجه (2065)، من طريق الحكم بن أبان، عن عكرمة، عن ابن عباس. وقال الترمذي: “حديث حسن غريب صحيح”. قلت: وهو حسن الإسناد من أجل الحكم بن أبان، وقد حسنه الحافظ نفسه في “الفتح” (9 /433). وأما إعلال الحديث بالإرسال، كما قال النسائي في “السنن” (668)، وأبو حاتم في “العلل” (1 /434307)، فهو مردود بقول ابن حزم في “المحلى” (10 /55). “هذا خبر صحيح من رواية الثقات، لا يضره إرسال من أرسله”. قلت: وما بعده أيضا يشهد له.

Narrated [Ibn ‘Abbas (RA)]: A man had vowed to make his wife like his mother (i.e. forbidden for him). Then he had intercourse with her, so he went to the Prophet (صلى الله عليه وسلم) and said, “I had intercourse with her before making the atonement.” He replied, “Do not go near her till you do what Allah has commanded you to do.” Reported by al-Arba’a. at-Tirmidhi graded it Sahih (authentic) but an-Nasa’i held that the stronger view is that it is Mursal (missing link after the Tabi’i)].

وَأَخْرَجَ اِبْنُ مَاجَهْ : عَنِ اَلْمِسْوَرِ بْنِ مَخْرَمَةَ مِثْلَهُ , وَإِسْنَادُهُ حَسَنٌ , لَكِنَّهُ مَعْلُولٌ أَيْضًا 1 . 1 – صحيح . رواه ابن ماجه (2048) ، وانظر ما قبله ، وما بعده . وحسن إسناده البوصيري في ” الزوائد “.

Ibn Majah reported a similar narration, on the authority of al-Miswar bin Makhramah, and its chain of narrators is (or appears to be) Hasan (good), but it is also Ma’lul (hidden defect)].

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ , عَنْ أَبِيهِ , عَنْ جَدِّهِ قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ لَا نَذْرَ لِابْنِ آدَمَ فِيمَا لَا يَمْلِكُ , وَلَا عِتْقِ لَهُ فِيمَا لَا يَمْلِكُ , وَلَا طَلَاقَ لَهُ فِيمَا لَا يَمْلِكُ } أَخْرَجَهُ أَبُو دَاوُدَ وَاَلتِّرْمِذِيُّ وَصَحَّحَهُ, وَنُقِلَ عَنْ اَلْبُخَارِيِّ أَنَّهُ أَصَحُّ مَا وَرَدَ فِيهِ 1 . 1 – صحيح. رواه أبو داود (2190 و 2191 و 2192)، والترمذي (1181)، وقال الأخير. ” وفي الباب عن علي، ومعاذ بن جبل، وجابر، وابن عباس، وعائشة. قال أبو عيسى: حديث عبد الله بن عمرو حديث حسن صحيح. وهو أحسن شيء روي في هذا الباب “. قلت: وقول البخاري نقله البيهقي في “الخلافيات”، وانظر “التلخيص” (310). وفي “الأصل” بيان لكل هذه الشواهد وطرقها.

Narrated ‘Amr bin Shu’aib on his father’s authority from his grandfather: Allah’s Messenger (صلى الله عليه وسلم) said: “No descendant of Adam may make a vow concerning something he does not possess, or set free (a slave) that he does not possess, or divorce (a woman) whom he does not possess (in marriage).” [Abu Dawud and at-Tirmidhi reported it; the latter graded it Sahih (authentic), and transmitted from al-Bukhari his statement that it is the most authentic Hadith on this subject].

وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا, عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ: { رُفِعَ اَلْقَلَمُ عَنْ ثَلَاثَةٍ: عَنِ اَلنَّائِمِ حَتَّى يَسْتَيْقِظَ, وَعَنِ اَلصَّغِيرِ حَتَّى يَكْبُرَ, وَعَنِ اَلْمَجْنُونِ حَتَّى يَعْقِلَ, أَوْ يَفِيقَ } رَوَاهُ أَحْمَدُ, وَالْأَرْبَعَةُ إِلَّا اَلتِّرْمِذِيَّ وَصَحَّحَهُ اَلْحَاكِمُ. 1 . 1 – صحيح. رواه أحمد (600-101و 144)، وأبو داود (4398)، والنسائي (656)، وابن ماجه (2041)، وابن حبان (142)، والحاكم (2 /59) بسند صحيح. وأيضا له شواهد أخرى مذكورة “بالأصل”.

Narrated ‘Aishah (RA): The Prophet (صلى الله عليه وسلم) said: “There are three people whose actions are not recorded, a sleeping person till he awakes, a child till he is a grown up, and an insane person till he is restored to reason or recovers his sense.” [Reported by Ahmad and al-Arba’a, except at-Tirmidhi. al-Hakim graded it Sahih (authentic)].

وَقَدْ رَوَى أَبُو دَاوُدَ مِنْ وَجْهٍ آخَرَ أَحْسَنَ مِنْهُ : { أَنَّ رُكَانَةَ طَلَّقَ اِمْرَأَتَهُ سُهَيْمَةَ اَلْبَتَّةَ , فَقَالَ : “وَاَللَّهِ مَا أَرَدْتُ بِهَا إِلَّا وَاحِدَةً, فَرَدَّهَا إِلَيْهِ اَلنَّبِيُّ -صَلَّى اَللَّهُ عَلَيْهِ وَسَلَّمَ } – 1 . 1 – ضعيف . رواه أبو داود ( 2206 ) وله علل.

Abu Dawud has reported (a Hadith) better than the aforesaid one through another chain, it has: “Abu Rukana divorced his wife Suhaimah irrevocably and said, ‘I swear by Allah that I meant it to be only a single utterance of divorce,’ so the Prophet (صلى الله عليه وسلم) returned her to him.”

وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ ثَلَاثٌ جِدُّهنَّ جِدٌّ , وَهَزْلُهُنَّ جِدٌّ : اَلنِّكَاحُ , وَالطَّلَاقُ , وَالرَّجْعَةُ } رَوَاهُ اَلْأَرْبَعَةُ إِلَّا النَّسَائِيَّ , وَصَحَّحَهُ اَلْحَاكِمُ 1 . 1 – حسن . رواه أبو داود (2194) ، والترمذي (1184) ، وابن ماجه ( 2039 ) ، وله شواهد منها ما ذكره الحافظ هنا ، وانظر ” التلخيص ” (3 / 209 – 210 ).

Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “There are three things which, whether undertaken seriously or in jest, are treated as serious: marriage, divorce and taking back a wife after a divorce which is not final.” [Reported by al-Arba’a except an-Nasa’i. al-Hakim graded it Sahih (authentic)].

وَفِي رِوَايَةٍ لِابْنِ عَدِيٍّ مِنْ وَجْهٍ آخَرَ ضَعِيفٍ : { اَلطَّلَاقُ , وَالْعِتَاقُ , وَالنِّكَاحُ } 1 . 1 – انظر ما قبله.

In a narration of Ibn ‘Adi, through another chain of narrators, which is Da’if (weak); it has: “Divorce, emancipation and marriage.”
