    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ ثَلَاثٌ جِدُّهنَّ جِدٌّ , وَهَزْلُهُنَّ جِدٌّ : اَلنِّكَاحُ , وَالطَّلَاقُ , وَالرَّجْعَةُ } رَوَاهُ اَلْأَرْبَعَةُ إِلَّا النَّسَائِيَّ , وَصَحَّحَهُ اَلْحَاكِمُ 1 . 1 – حسن . رواه أبو داود (2194) ، والترمذي (1184) ، وابن ماجه ( 2039 ) ، وله شواهد منها ما ذكره الحافظ هنا ، وانظر ” التلخيص ” (3 / 209 – 210 ).

    Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “There are three things which, whether undertaken seriously or in jest, are treated as serious: marriage, divorce and taking back a wife after a divorce which is not final.” [Reported by al-Arba’a except an-Nasa’i. al-Hakim graded it Sahih (authentic)].

    وَفِي رِوَايَةٍ لِابْنِ عَدِيٍّ مِنْ وَجْهٍ آخَرَ ضَعِيفٍ : { اَلطَّلَاقُ , وَالْعِتَاقُ , وَالنِّكَاحُ } 1 . 1 – انظر ما قبله.

    In a narration of Ibn ‘Adi, through another chain of narrators, which is Da’if (weak); it has: “Divorce, emancipation and marriage.”

    وَلِلْحَارِثِ اِبْنِ أَبِي أُسَامَةَ : مِنْ حَدِيثِ عُبَادَةَ بْنِ اَلصَّامِتِ رَفَعَهُ : { لَا يَجُوزُ اَللَّعِبُ فِي ثَلَاثٍ : اَلطَّلَاقُ , وَالنِّكَاحُ , وَالْعِتَاقُ , فَمَنْ قَالَهُنَّ فَقَدَ وَجَبْنَ } وَسَنَدُهُ ضَعِيفٌ 1 . 1 – انظر ما قبله . وفي ” الأصل ” تفصيل لطرق وشواهد الحديث.

    al-Harith bin Abu Usamah reported from the Hadith of ‘Ubadah bin as-Samit [RA) – tracing it to the Prophet (صلى الله عليه وسلم): “It is not permissible to play in three things: divorce, marriage and emancipation. Therefore, whoever pronounce (either of) them, they certainly become binding.” [Its chain of narrators is Da’if (weak)].

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – عَنِ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ : { إِنَّ اَللَّهَ تَجَاوَزَ عَنْ أُمَّتِي مَا حَدَّثَتْ بِهِ أَنْفُسَهَا , مَا لَمْ تَعْمَلْ أَوْ تَكَلَّمْ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح . رواه البخاري ( 5269 ) ، ومسلم ( 127 ) ، من طريق قتادة ، عن زرارة بن أوفى ، عن أبي هريرة ، به . وزاد البخاري : ” قال قتادة : إذا طلق في نفسه فليس بشيء “.

    Narrated Abu Hurairah (RA): The Prophet (صلى الله عليه وسلم) said: “Allah, the Most High, has forgiven my followers what they contemplate on within themselves (i.e. evil thoughts) as long as they do not act upon or speak about them.” [Agreed upon].

    وَعَنِ اِبْنِ عَبَّاسٍ – رَضِيَ اَللَّهُ عَنْهُمَا- , عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ : { إِنَّ اَللَّهَ تَعَالَى وَضَعَ عَنْ أُمَّتِي اَلْخَطَأَ , وَالنِّسْيَانَ , وَمَا اسْتُكْرِهُوا عَلَيْهِ } رَوَاهُ اِبْنُ مَاجَهْ , وَالْحَاكِمُ , وَقَالَ أَبُو حَاتِمٍ : لَا يَثْبُتُ 1 . 1 – صحيح . رواه ابن ماجه ( 2045 ) ، والحاكم ( 2 / 189 ) ، وفي ” الأصل ” تفصيل ذلك وبيان من صححه من العلماء.

    Narrated Ibn ‘Abbas (RA): The Prophet (صلى الله عليه وسلم)) said: “Allah, the Most High, has overlooked my follower’s mistakes and forgetfulness, and what they are forced to do against their will.” [Reported by Ibn Majah and al-Hakim. Abu Hatim said that it is not an established (authentic) Hadith].

    وَعَنِ اِبْنِ عَبَّاسٍ – رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ : { إِذَا حَرَّمَ اِمْرَأَتَهُ لَيْسَ بِشَيْءٍ } . وَقَالَ : ﴿ لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اَللَّهِ أُسْوَةٌ حَسَنَةٌ ﴾ 1 اَلْأَحْزَاب : 21 . رَوَاهُ اَلْبُخَارِيُّ 2 . 1 – صحيح . رواه ابن ماجه ( 2045 ) ، والحاكم ( 2 / 189 ) ، وفي ” الأصل ” تفصيل ذلك وبيان من صححه من العلماء. 2 – صحيح . رواه البخاري ( 5266 ).

    Narrated Ibn ‘Abbas (RA): “If anyone makes his wife unlawful for himself – it is nothing.” He said, “Indeed you have a good example in Allah’s Messenger.” [Reported by al-Bukhari].

    وَعَنِ اِبْنِ عُمَرَ – رَضِيَ اَللَّهُ عَنْهُمَا { أَنَّهُ طَلَّقَ اِمْرَأَتَهُ – وَهِيَ حَائِضٌ – فِي عَهْدِ رَسُولِ اَللَّهِ – صلى الله عليه وسلم -فَسَأَلَ عُمَرُ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -عَنْ ذَلِكَ ? فَقَالَ : ” مُرْهُ فَلْيُرَاجِعْهَا , ثُمَّ لْيُمْسِكْهَا حَتَّى تَطْهُرَ , ثُمَّ تَحِيضَ , ثُمَّ تَطْهُرَ , ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ , وَإِنْ شَاءَ طَلَّقَ بَعْدَ أَنْ يَمَسَّ , فَتِلْكَ اَلْعِدَّةُ اَلَّتِي أَمَرَ اَللَّهُ أَنْ تُطَلَّقَ لَهَا اَلنِّسَاءُ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح . رواه البخاري (5251) ، ومسلم ( 1471) (1).

    Narrated Ibn ‘Umar (RA): In the time of Allah’s Messenger (صلى الله عليه وسلم), he divorced his wife while she was menstruating, so ‘Umar asked Allah’s Messenger (صلى الله عليه وسلم) about that and he replied, “Command him to take her back and keep her till she is purified (from menses), has another period, and is then purified. If he then wishes he may keep her and if he wishes he may divorce her before having intercourse with her. That is the ‘Iddah (period of waiting) which Allah commanded for the divorce of women.” [Agreed upon].

    وَفِي رِوَايَةٍ لِمُسْلِمٍ : { مُرْهُ فَلْيُرَاجِعْهَا, ثُمَّ لْيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلًا } 1 . 1 – صحيح . وهذه الرواية في مسلم برقم (1471) (5).

    A narration by Muslim has: “Command him to take her back, then divorce her when she is pure from the menstrual discharge, or pregnant.”

    وَفِي رِوَايَةٍ أُخْرَى لِلْبُخَارِيِّ : { وَحُسِبَتْ عَلَيْهِ تَطْلِيقَةً } 1 . 1 – صحيح . وهي في البخاري برقم (5253) ، ولفظه عن ابن عمر قال : حسبت علي بتطليقة.

    Another narration by al-Bukhari has: “It was regarded as one divorce.”

    وَفِي رِوَايَةٍ لِمُسْلِمٍ : قَالَ اِبْنُ عُمَرَ : { أَمَّا أَنْتَ طَلَّقْتَهَا وَاحِدَةً أَوْ اِثْنَتَيْنِ ; فَإِنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -أَمَرَنِي أَنْ أُرَاجِعَهَا , ثُمَّ أُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى , وَأَمَّا أَنْتَ طَلَّقْتَهَا ثَلَاثًا , فَقَدْ عَصَيْتَ رَبَّكَ فِيمَا أَمَرَكَ مِنْ طَلَاقِ اِمْرَأَتِكَ } 1 . 1 – صحيح . وهي في مسلم برقم (1471) (3) ولفظه : ” . . . فكان ابن عمر إذا سئل عن الرجل يطلق امرأته وهي حائض ؟ يقول : أما أنت طلقتها واحدة أو اثنتين . إن رسول الله -صلى الله عليه وسلم- أمره أن يرجعها . ثم يمهلها حتى تحيض حيضة أخرى . ثم يمهلها حتى تطهر . ثم يطلقها قبل أن يمسها . وأما أنت طلقتها ثلاثا . فقد عصيت ربك فيما أمرك به من طلاق امرأتك . وبانت منك.

    A narration of Muslim has: “Ibn ‘Umar (RA) said: ‘If you had only made one or two pronouncements of divorce [it would have been better]. Indeed Allah’s Messenger (صلى الله عليه وسلم) commanded me to take her back, then keep her till she has another period, then give her a reprieve till she is purified, then divorce her before having intercourse with her. As for you, you have divorced her with three pronouncements (at once), and have therefore disobeyed your Rabb (your Lord, the Creator) concerning what He commanded you regarding divorcing your wife.’”
