    وَعَنْ عَبْدِ اَللَّهِ بْنِ زَمْعَةَ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ لَا يَجْلِدُ أَحَدُكُمْ اِمْرَأَتَهُ جَلْدَ اَلْعَبْدِ } رَوَاهُ اَلْبُخَارِيّ ُ 1 . 1 – صحيح . رواه البخاري (5204) ، وتمامه : ” ثم يجامعها في آخر اليوم ” . قلت : وهو في البخاري ومسلم أيضا بلفظ آخر.

    Narrated ‘Abdullah bin Zam’ah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “None of you should whip his wife like the whipping of a slave.” [Reported by al-Bukhari].

    عَنْ اِبْنِ عَبَّاسٍ – رَضِيَ اَللَّهُ عَنْهُمَا- { أَنَّ اِمْرَأَةَ ثَابِتِ بْنِ قَيْسٍ أَتَتْ اَلنَّبِيَّ – صلى الله عليه وسلم -فَقَالَتْ : يَا رَسُولَ اَللَّهِ ! ثَابِتُ بْنُ قَيْسٍ مَا أَعِيبُ عَلَيْهِ فِي خُلُقٍ وَلَا دِينٍ , وَلَكِنِّي أَكْرَهُ اَلْكُفْرَ فِي اَلْإِسْلَامِ , قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ ? ” , قَالَتْ : نَعَمْ . قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” اِقْبَلِ اَلْحَدِيقَةَ , وَطَلِّقْهَا تَطْلِيقَةً } رَوَاهُ اَلْبُخَارِيُّ .

    Narrated Ibn ‘Abbas (RA): The wife of Thabit bin Qais came to the Prophet (صلى الله عليه وسلم) and said, “O Allah’s Messenger, I do not find fault with Thabit bin Qais (RA) in respect of character or religion, but I dislike (and fear) that I might commit an act of Kufr fil-Islam (that which is contradictory to Islamic behavior).” Allah’s Messenger (صلى الله عليه وسلم) asked her, “Will you give him back his garden?” And she replied, “Yes,” so Allah’s Messenger (صلى الله عليه وسلم) said to him, “Accept the garden and divorce her, with one pronouncement (of divorce).” [Reported by al-Bukhari].

    وَفِي رِوَايَةٍ لَهُ : { وَأَمَرَهُ بِطَلَاقِهَا } 1 . 1 – صحيح . رواه البخاري ( 9 / 395 / فتح ).

    Another narration by him has: “He commanded him to divorce her.”

    وَلِأَبِي دَاوُدَ , وَاَلتِّرْمِذِيِّ وَحَسَّنَهُ : { أَنَّ اِمْرَأَةَ ثَابِتِ بْنِ قَيْسٍ اِخْتَلَعَتْ مِنْهُ , فَجَعَلَ اَلنَّبِيُّ – صلى الله عليه وسلم -عِدَّتَهَا حَيْضَةً } 1 . 1 – حسن . رواه أبو داود ( 2229 ) ، والترمذي ( 1185 ) ، وقال الترمذي : ” هذا حديث حسن غريب “.

    Abu Dawud and at-Tirmidhi reported this Hadith and the later graded it Hasan (good): “The wife of Thabit bin Qais got a divorce from him in return for a compensation (paid by her), and the Prophet (صلى الله عليه وسلم) made her ‘Iddah (period of waiting before re-marrying) one menstruation course.”

    وَفِي رِوَايَةِ عَمْرِوِ بْنِ شُعَيْبٍ , عَنْ أَبِيهِ , عَنْ جَدِّهِ عِنْدَ اِبْنِ مَاجَهْ : { أَنَّ ثَابِتَ بْنَ قَيْسٍ كَانَ دَمِيمً ا 1 وَأَنَّ اِمْرَأَتَهُ قَالَتْ : لَوْلَا مَخَافَةُ اَللَّهِ إِذَا دَخَلَ عَلَيَّ لَبَسَقْتُ فِي وَجْهِهِ } 2 . 1 – دميما: قبيح الوجه. 2 – ضعيف . رواه ابن ماجه ( 2507 ) ، وفي سنده الحجاج بن أرطأة، وهو مدلس وقد عنعن.

    Ibn Majah reported the narration of ‘Amr bin Shu’aib, on this father’s authority, from his grandfather: “Thabit bin Qais was very unattractive and his wife said, ‘Were it not for the fear of Allah, when he entered my presence I would spit in his face.’”

    وَلِأَحْمَدَ : مِنْ حَدِيثِ سَهْلِ بْنِ أَبِي حَثْمَةَ : { وَكَانَ ذَلِكَ أَوَّلَ خُلْعٍ فِي اَلْإِسْلَامِ } 1 . 1 – ضعيف . رواه أحمد ( 4 / 3 ) وعلته كعلة سابقه.

    Ahmad reported from Sahl bin Abu Hathma’s Hadith that it was the first ever husband and wife separation for compensation in Islam.

    عَنْ عَائِشَةَ -رَضِيَ اَللَّهُ عَنْهَا- قَالَتْ : { كَانَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -يَقْسِمُ , فَيَعْدِلُ , وَيَقُولُ : “اَللَّهُمَّ هَذَا قَسْمِي فِيمَا أَمْلِكُ , فَلَا تَلُمْنِي فِيمَا تَمْلِكُ وَلَا أَمْلِكُ } رَوَاهُ اَلْأَرْبَعَةُ , وَصَحَّحَهُ اِبْنُ حِبَّانَ وَالْحَاكِمُ , وَلَكِنْ رَجَّحَ اَلتِّرْمِذِيُّ إِرْسَالَه ُ 1 . 1 – ضعيف . رواه أبو داود ( 2134 ) ، والنسائي ( 7 / 64 ) ، والترمذي ( 1140 ) ، وابن ماجه ( 1971 ) ، وابن حبان ( 1305 ) ، والحاكم ( 2 / 187 ) ، من طريق حماد بن سلمة ، عن أيوب ، عن أبي قلابة ، عن عبد الله بن يزيد ، عن عائشة ، به . وقال الترمذي : ” حديث عائشة هكذا رواه غير واحد ، عن حماد بن سلمة ، عن أيوب ، عن أبي قلابة ، عن عبد الله بن يزيد ، عن عائشة ؛ أن النبي -صلى الله عليه وسلم- . ورواه حماد بن زيد – وغير واحد – عن أيوب ، عن أبي قلابة مرسلا ؛ أن النبي -صلى الله عليه وسلم- كان يقسم . وهذا أصح من حديث حماد بن سلمة ” . قلت : وبمثل ما أعله الترمذي أعله غير واحد من جهابذة الحفاظ كأبي زرعة ، وابن أبي حاتم ، كما تجده في ” العلل ” ( 1 / 425 / 1279 ).

    Narrated ‘Aishah (RA): Allah’s Messenger (صلى الله عليه وسلم) used to divide visits to his wives equally and say, “O Allah, this is my division concerning what I possess, so do not blame me concerning what You possess and I do not.” [Reported by al-Arba’a; Ibn Hibban and al-Hakim graded it Sahih (authentic). at-Tirmidhi held that the stronger view is that it is Mursal (a missing link in the chain after the Tabi’i)].

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ : { مَنْ كَانَتْ لَهُ اِمْرَأَتَانِ , فَمَالَ إِلَى إِحْدَاهُمَا , جَاءَ يَوْمَ اَلْقِيَامَةِ وَشِقُّهُ مَائِلٌ } رَوَاهُ أَحْمَدُ , وَالْأَرْبَعَةُ , وَسَنَدُهُ صَحِيح ٌ 1 . 1 – صحيح . رواه أحمد ( 2 / 347 و 471 ) ، وأبو داود ( 2133 ) ، والنسائي ( 7 / 63 ) ، والترمذي (1141) ، وابن ماجه (1969) . قلت : وقد أعل بعلة غريبة لا تقدح فيه ، ولذلك صححه الحافظ كابن الجارود . وابن حبان . والحاكم . والذهبي . وابن دقيق العيد ، وغيرهم.

    Narrated Abu Hurairah (RA): The Prophet (صلى الله عليه وسلم) said: “Anyone who has two wives and inclines to one of them will come on the Day of Resurrection with a side (of his body) inclining.” [Reported by Ahmad and al-Arba’a; its chain of narrators is Sahih (authentic)].

    وَعَنْ أَنَسٍ قَالَ : { مِنَ اَلسُّنَّةِ إِذَا تَزَوَّجَ اَلرَّجُلُ اَلْبِكْرَ عَلَى اَلثَّيِّبِ أَقَامَ عِنْدَهَا سَبْعًا , ثُمَّ قَسَمَ , وَإِذَا تَزَوَّجَ اَلثَّيِّبَ أَقَامَ عِنْدَهَا ثَلَاثًا , ثُمَّ قَسَمَ } مُتَّفَقٌ عَلَيْهِ , وَاللَّفْظُ لِلْبُخَارِيّ ِ 1 . 1 – صحيح . رواه البخاري ( 5214 ) ، ومسلم ( 1461) من طريق أبي قلابة ، عن أنس . وزاد البخاري : ” قال أبو قلابة : ولو شئت لقلت : إن أنسا رفعه إلى النبي -صلى الله عليه وسلم- ” . وهي بمعناها عند مسلم أيضا.

    Narrated Anas (RA): It is from the Sunnah that when a man who has a wife marries a virgin, he should spend with her seven nights, and thereafter divide time between them (equally). And if he marries a formerly married woman he should spend with her three nights and thereafter divide the time between his wives (equally). [Agreed upon: the wording is al-Bukhari’s].

    وَعَنْ أُمِّ سَلَمَةَ -رَضِيَ اَللَّهُ عَنْهَا- { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -لَمَّا تَزَوَّجَهَا أَقَامَ عِنْدَهَا ثَلَاثًا , وَقَالَ : ” إِنَّهُ لَيْسَ بِكِ عَلَى أَهْلِكِ هَوَانٌ , إِنْ شِئْتِ سَبَّعْتُ لَكِ , وَإِنْ سَبَّعْتُ لَكِ سَبَّعْتُ لِنِسَائِي } رَوَاهُ مُسْلِم ٌ 1 . 1 – صحيح . رواه مسلم (1460) (41).

    Narrated Umm Salamah (RA): When the Prophet (صلى الله عليه وسلم) married her he stayed with her for three nights and said, “You are not being humbles in my estimation. If you wish I shall stay with you seven nights, and if I stay with you for seven nights I shall do the same with my other wives.” [Reported by Muslim].
