    وَعَنْ أَنَسٍ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ تَهَادَوْا , فَإِنَّ اَلْهَدِيَّةَ تَسُلُّ اَلسَّخِيمَةَ } رَوَاهُ اَلْبَزَّارُ بِإِسْنَادٍ ضَعِيف ٍ 1 . 1 – رواه البزار (1937 ) ، وهو وإن كان ضعيف المسند فهو أحد شواهد الحديث السابق.

    Narrated Anas (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “Give gifts to one another, for (giving) gifts gently extracts resentment and ill-will.” [al-Bazzar reported it through a Da’if (weak) chain of narrators].

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ يَا نِسَاءَ اَلْمُسْلِمَاتِ ! لَا تَحْقِرَنَّ جَارَةٌ لِجَارَتِهَا وَلَوْ فِرْسِنَ شَاةٍ } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح رواه البخاري (2566 ) ، ومسلم ( 1030 ) . و “فرسن” : قال الحافظ في “الفتح” : “بكسر الفاء والمهملة بينهما راء ساكنة وآخره نون ، وهو: عظيم قليل اللحم ، وهو للبعير موضع الحافر للفرس، ويطلق على الشاة مجازا ، ونونه زائدة وقيل: أصلية ، وأشير بذلك إلى المبالغة في إهداء الشيء اليسير وقبوله لا إلى حقيقة الفرسن؛ لأنه لم تجر العادة بإهدائه، أي : لا تمنع جارة من الهدية لجارتها الموجود عندها لاستقلاله ، بل ينبغي أن تجود لها بما تيسر، وإن كان قليلا فهو خير من العدم، وذكر الفرسن على سبيل المبالغة.

    Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “O Muslim women, a woman neighbor should not consider even a goat’s hoof too insignificant a gift to give to her neighbor.” [Agreed upon].

    وَعَنْ اِبْنِ عُمَرَ -رَضِيَ اَللَّهُ عَنْهُمَا- , عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ : { مَنْ وَهَبَ هِبَةً , فَهُوَ أَحَقُّ بِهَا , مَا لَمْ يُثَبْ عَلَيْهَا } رَوَاهُ اَلْحَاكِمُ وَصَحَّحَهُ , وَالْمَحْفُوظُ مِنْ رِوَايَةِ اِبْنِ عُمَرَ, عَنْ عُمَرَ قَوْلُه ُ 1 1 – لا يصح رفعه . رواه الحاكم ( 2 / 52 ) ، مرفوعا وقال: “هذا الحديث صحيح على شرط الشيخين، ولم يخرجاه ، إلا أن يكون الحمل فيه على شيخنا” . قلت: وشيخه هو : إسحاق بن محمد بن خالد الهاشمي ، قال الحافظ في ” اللسان ” (1 /417) : ” الحمل فيه عليه بلا ريب ، وهذا الكلام معروف من قول عمر غير مرفوع ” . وأما الموقوف ، فرواه مالك في ” الموطأ ” ( 2 / 754 / 42 ) بسند صحيح ، ولفظه : ” من وهب هبة لصلة رحم ، أو على وجه صدقة ، فإنه لا يرجع فيها. ومن وهب هبة يرى أنه إنما أراد بها الثواب ، فهو على هبته ، يرجع فيها إذا لم يرض منها “.

    Narrated Ibn ‘Umar (RA): The Prophet (صلى الله عليه وسلم) said: “If anyone gives away a gift, he has most right to it as long as he is given nothing in return for it.” [al-Hakim reported and graded it Sahih (authentic). However, the stronger narration is Ibn ‘Umar’s narration on the authority of ‘Umar (RA) as a saying of ‘Umar].

    عَنْ أَنَسٍ – رضى الله عنه – قَالَ : { مَرَّ اَلنَّبِيُّ – صلى الله عليه وسلم -بِتَمْرَةٍ فِي اَلطَّرِيقِ، فَقَالَ : ” لَوْلَا أَنِّي أَخَافُ أَنْ تَكُونَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا” } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح . رواه البخاري ( 2431 ) ، ومسلم ( 1071 ) والسياق للبخاري.

    Narrated Anas (RA): The Prophet (صلى الله عليه وسلم) came upon a date on the road and said, “Were it not that I fear it may be part of the Sadaqah I would eat it.” [Agreed upon].

    وَعَنْ زَيْدِ بْنِ خَالِدٍ اَلْجُهَنِيِّ – رضى الله عنه – قَالَ : { جَاءَ رَجُلٌ إِلَى اَلنَّبِيِّ – صلى الله عليه وسلم -فَسَأَلَهُ عَنِ اللُّقَطَةِ ? فَقَالَ : ” اِعْرِفْ عِفَاصَهَا وَوِكَاءَهَا , ثُمَّ عَرِّفْهَا سَنَةً , فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنُكَ بِهَا” . فِيهِ اَلَّذِي قَبْلَهُ وَمَا أَشْبَهَهُ قَالَ : “هِيَ لَكَ , أَوْ لِأَخِيكَ , أَوْ لِلذِّئْبِ ” . قَالَ : فَضَالَّةُ اَلْإِبِلِ ? قَالَ : ” مَا لَكَ وَلَهَا ? مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا , تَرِدُ اَلْمَاءَ , وَتَأْكُلُ اَلشَّجَرَ , حَتَّى يَلْقَاهَا رَبُّهَا } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح . رواه البخاري ( 91 ) ، ومسلم ( 1722 ) . و ” عفاصها ” بكسر المهملة ، وتخفيف الفاء ، الوعاء تكون فيه النفقة . و ” وكاءها ” : الخيط يشد به العفاص . و ” سقاؤها ” : جوفها . و ” حذاؤها ” : خفها . وفي هذا تنبيه من النبي -صلى الله عليه وسلم- إلى أن الإبل غير محتاجة إلى الحفظ بما ركب الله في طباعها من الجلادة على العطش وتناول الماء بغير تعب لطول عنقها ، وقوتها على المشي.

    Narrated Zaid bin Khalid al-Juhani (RA): A man came to the Prophet (صلى الله عليه وسلم) and asked him about an item found (in the street). He replied, “Note what it is contained in, and what it is tied with, and make the matter known for a year. Then, if its owner comes (give it to him). Otherwise, you can do what you like with it.” He asked, “What about astray sheep?” He replied, “It is for your, your brother, or the wolf.” He asked, “What about astray camels?” He replied, “What have you to do with them? They have their stomachs and their feet. They can go down to water and eat trees till their master finds them.” [Agreed upon].

    وَلِمُسْلِمٍ : { أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلَا تُفْسِدُوهَا , فَإِنَّهُ مَنْ أَعْمَرَ عُمْرَى فَهِيَ لِلَّذِي أُعْمِرَهَا حَياً وَمَيِّتًا، وَلِعَقِبِهِ } 1 . 1 – صحيح . رواه مسلم ( 1625 ) ( 26 ).

    Muslim has: “Keep your properties for yourselves and do not squander them, for if anyone gives a life-tenancy it goes to the one to whom it is given, both during his life and after his death, and to his descendants.”

    { وَأَمَّا خَالِدٌ فَقَدْ اِحْتَبَسَ أَدْرَاعَهُ وَأَعْتَادَهُ فِي سَبِيلِ اَللَّهِ } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – تقدم برقم (885).

    “As for Khalid, he has kept back his coats of mail and weapons to use them in Allah’s Cause.” [Agreed upon].

    عَنْ اَلنُّعْمَانِ بْنِ بَشِيرٍ -رَضِيَ اَللَّهُ عَنْهُمَا- أَنَّ أَبَاهُ أَتَى بِهِ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -فَقَالَ : { إِنِّي نَحَلْتُ اِبْنِي هَذَا غُلَامًا كَانَ لِي، فَقَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” أَكُلُّ وَلَدِكَ نَحَلْتَهُ مِثْلَ هَذَا” ?. فَقَالَ : لَا . فَقَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” فَارْجِعْهُ” } 1 . 1 – صحيح . وهذه الرواية للبخاري ( 2586 ) ، ومسلم ( 1623) (9).

    Narrated an-Nu’man bin Bashir (RA): His father brought him to Allah’s Messenger (صلى الله عليه وسلم) and said, “I have given this son of mine a slave, who was belonging to me.” Allah’s Messenger (صلى الله عليه وسلم) asked, “Have you given all your children the like of him?” He replied, “No.” Allah’s Messenger (صلى الله عليه وسلم) then said, “Take him back then.”

    وَفِي لَفْظٍ : { فَانْطَلَقَ أَبِي إِلَى اَلنَّبِيِّ – صلى الله عليه وسلم -لِيُشْهِدَهُ عَلَى صَدَقَتِي. فَقَالَ : ” أَفَعَلْتَ هَذَا بِوَلَدِكَ كُلِّهِمْ”?. قَالَ : لَا. قَالَ: ” اِتَّقُوا اَللَّهَ , وَاعْدِلُوا بَيْنَ أَوْلَادِكُمْ ” فَرَجَعَ أَبِي, فَرَدَّ تِلْكَ اَلصَّدَقَةَ } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – هذه الرواية للبخاري ( 2587 ) ، ومسلم (1623) (13) والسياق لمسلم.

    A narration has: My father went then to the Prophet (صلى الله عليه وسلم) to call him as a witness to my Sadaqah (i.e. gift) and he asked, “Have you done the same with all your children?” He replied, “No.” He said, “Fear Allah and treat your children equally.” My father then returned and took back that gift. [Agreed upon].

    وَفِي رِوَايَةٍ لِمُسْلِمٍ قَالَ : { فَأَشْهِدْ عَلَى هَذَا غَيْرِي” ثُمَّ قَالَ : ” أَيَسُرُّكَ أَنْ يَكُونُوا لَكَ فِي اَلْبِرِّ سَوَاءً”? قَالَ : بَلَى . قَالَ : ” فَلَا إِذًا } 1 . 1 – مسلم برقم ( 1623 ) ( 17 ).

    A narration by Muslim has: He said, “Call someone other than me as a witness to this.” He then said, “Would you like them to be equal in their kind treatment of you?” He replied, “Yes.” He said, “Don’t do it, then.”
