    وَعَنْ اِبْنِ عَبَّاسٍ -رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ : قَالَ اَلنَّبِيُّ – صلى الله عليه وسلم -{ اَلْعَائِدُ فِي هِبَتِهِ كَالْكَلْبِ يَقِيءُ, ثُمَّ يَعُودُ فِي قَيْئِهِ” } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح . رواه البخاري (2589) ، ومسلم (1622) (8).

    Narrated Ibn ‘Abbas (RA): The Prophet (صلى الله عليه وسلم) said: “The one who repossesses a gift is like a dog which vomits and then returns to its vomit.” [Agreed upon].

    وَفِي رِوَايَةٍ لِلْبُخَارِيِّ : { لَيْسَ لَنَا مَثَلُ اَلسَّوْءِ, اَلَّذِي يَعُودُ فِي هِبَتِهِ كَالْكَلْبِ يَرْجِعُ فِي قَيْئِهِ } 1 . 1 – البخاري برقم ( 2622 ).

    A narration by al-Bukhari has: “An evil example does not apply to us, one who repossesses a gift is like a dog which vomits and then returns to its vomit.”

    وَعَنْ اِبْنِ عُمَرَ ، وَابْنِ عَبَّاسٍ -رَضِيَ اَللَّهُ عَنْهُمْ- , عَنْ اَلنَّبِيِّ – صلى الله عليه وسلم -قَالَ : { لَا يَحِلُّ لِرَجُلٍ مُسْلِمٍ أَنْ يُعْطِيَ اَلْعَطِيَّةَ , ثُمَّ يَرْجِعَ فِيهَا ; إِلَّا اَلْوَالِدُ فِيمَا يُعْطِي وَلَدَهُ” } رَوَاهُ أَحْمَدُ , وَالْأَرْبَعَةُ , وَصَحَّحَهُ اَلتِّرْمِذِيُّ , وَابْنُ حِبَّانَ , وَالْحَاكِم ُ 1 . 1 – صحيح . رواه أحمد ( 2 7 و 78 ) ، وأبو داود ( 3539 ) ، والنسائي ( 6 / 267 – 268 ) ، والترمذي ( 2132 ) ، وابن ماجه ( 2377 ) ، وابن حبان ( 5101 ) ، والحاكم ( 2 / 46 ) وزادوا جميعا إلا ابن ماجه : “ومثل الذي يعطي العطية ، ثم يرجع فيها كمثل الكلب، حتى إذا شبع قاء ، ثم عاد في قيئه”. وقال الترمذي : ” هذا حديث حسن صحيح “.

    Narrated Ibn ‘Umar and Ibn ‘Abbas (RA): The Prophet (صلى الله عليه وسلم) said: “It is not lawful for a Muslim man to give a gift and then take it back, except a father regarding what he gives a child.” [Reported by Ahmad and al-Arba’a. at-Tirmidhi, Ibn Hibban and al-Hakim graded it Sahih (authentic)].

    وَعَنْ عَائِشَةَ -رَضِيَ اَللَّهُ عَنْهَا- قَالَتْ : { كَانَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -يَقْبَلُ اَلْهَدِيَّةَ , وَيُثِيبُ عَلَيْهَا } رَوَاهُ اَلْبُخَارِيّ ُ 1 . 1 – صحيح . رواه البخاري ( 2585).

    Narrated ‘Aishah (RA): Allah’s Messenger (صلى الله عليه وسلم) would accept a gift and give something in return for it. [Reported by al-Bukhari].

    وَعَنْ اِبْنِ عَبَّاسٍ -رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ : { وَهَبَ رَجُلٌ لِرَسُولِ اَللَّهِ – صلى الله عليه وسلم -نَاقَةً، فَأَثَابَهُ عَلَيْهَا , فَقَالَ : ” رَضِيتَ” ? قَالَ : لَا . فَزَادَهُ , فَقَالَ : “رَضِيتَ”? قَالَ : لَا . فَزَادَهُ . قَالَ : “رَضِيتَ” ? قَالَ : نَعَمْ. } رَوَاهُ أَحْمَدُ , وَصَحَّحَهُ اِبْنُ حِبَّان َ 1 1 – صحيح . رواه أحمد (2 95) ، وابن حبان ( 1146 موارد ) وزادا : ” فقال رسول الله -صلى الله عليه وسلم- : لقد هممت أن لا أتهب هبة من قرشي ، أو أنصاري ، أو ثقفي ” . قلت : وقوله : “أتهب” بالتاء المشددة ، أي : أقبل الهدية ، وأما سبب هم النبي -صلى الله عليه وسلم- بعدم قبول الهدية إلا من هؤلاء فهو كما يقول ابن الأثير (5/ 231) : “لأنهم أصحاب مدن وقرى ، وهم أعرف بمكارم الأخلاق؛ ولأن في أخلاق البادية جفاء ، وذهابا عن المروءة ، وطلبا للزيادة”.

    Narrated Ibn ‘Abbas (RA): A man gave away a she-camel to Allah’s Messenger (صلى الله عليه وسلم). So he gave him something in return for it and asked, “Are you pleased?” He replied, “No.” So he gave him more and asked, “Are you pleased?” He replied, “No.” Again he gave him more and asked, “Are you pleased?” He replied, “Yes.” [Reported by Ahmad and Ibn Hibban graded it Sahih (authentic)].

    وَعَنْ جَابِرٍ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ اَلْعُمْرَى لِمَنْ وُهِبَتْ لَهُ } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – صحيح . رواه البخاري ( 2625 ) ، ومسلم ( 1625 ) ( 25 ) ، والسياق لمسلم ، وأما البخاري فعن جابر قال : قضى النبي -صلى الله عليه وسلم- بالعمرى أنها لمن وهبت له.

    Narrated Jabir (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “What is given in life-tenancy belongs to the one to whom it is given.” [Agreed upon].

    { وَأَمَّا خَالِدٌ فَقَدْ اِحْتَبَسَ أَدْرَاعَهُ وَأَعْتَادَهُ فِي سَبِيلِ اَللَّهِ } مُتَّفَقٌ عَلَيْه ِ 1 . 1 – تقدم برقم (885).

    “As for Khalid, he has kept back his coats of mail and weapons to use them in Allah’s Cause.” [Agreed upon].

    وَلَهُ مِنْ حَدِيثِ أَبِي سَعِيدٍ مِثْلُهُ, وَهُوَ فِي اَلْمُوَطَّإِ مُرْسَلٌ 1 . 1 – الموطأ ( 2 / 745 / رقم 31 )، وانظر ما قبله.

    Ibn Majah reported something similar to the aforesaid Hadith from Abu Sa’id’s narration. It is found in al-Muwatta’ in a Mursal form (missing link after the Tabi’i).

    وَعَنْ سَمُرَةَ بْنِ جُنْدُبٍ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضٍ فَهِيَ لَهُ } رَوَاهُ أَبُو دَاوُدَ, وَصَحَّحَهُ اِبْنُ اَلْجَارُودِ 1 . 1 – حديث صحيح. بما له من شواهد كما تقد م رقم ( 897 و 898 )، وإن رواه أبو داود ( 3077 )، وابن الجارود ( 1015 ) بسند ضعيف.

    Narrated Samurah bin Jundub (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “If anyone puts a wall around a (barren) land, it belongs to him.” [Reported by Abu Dawud and Ibn al-Jarud graded it Sahih (authentic)].

    وَعَنْ عَبْدِ اَللَّهِ بْنِ مُغَفَّلٍ – رضى الله عنه – أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ: { مَنْ حَفَرَ بِئْرًا فَلَهُ أَرْبَعُونَ ذِرَاعًا عَطَنًا لِمَاشِيَتِهِ } رَوَاهُ اِبْنُ مَاجَهْ بِإِسْنَادٍ ضَعِيفٍ 1 . 1 – حسن. رواه ابن ماجه ( 2486 ) وسنده ضعيف كما قال الحافظ، لكن يشهد له حديث أبي هريرة عند أحمد ( 2 / 494 )، وله شاهد آخر مرسل في ” مراسيل ” أبي داود.

    Narrated ‘Abdullah bin Mughaffal (RA): The Prophet (صلى الله عليه وسلم), “Whoever digs a well, shall have forty cubits (of land) as resting place for his animals near the water.” [Reported by Ibn Majah through a weak chain of narrators].
