    وَعَنْ سَمُرَةَ – رضى الله عنه – أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -قَالَ: { “كُلُّ غُلَامٍ مُرْتَهَنٌ بِعَقِيقَتِهِ, تُذْبَحُ عَنْهُ يَوْمَ سَابِعِهِ, وَيُحْلَقُ, وَيُسَمَّى” } رَوَاهُ اَلْخَمْسَةُ, وَصَحَّحَهُ اَلتِّرْمِذِيّ ُ (1783) . 1 – صحيح. رواه أحمد ( 5 / 7 – 8 و 12 و 17 )، وأبو داود ( 2838 )، والنسائي، (7/166)، والترمذي (1522)، وابن ماجه (3165) وقال الترمذي: “حديث حسن صحيح”.

    Samurah (RAA) narrated that Allah’s Messenger (صلى الله عليه وسلم) said: “Every boy is pawned against his ‘Aqiqah, to be slaughtered on his behalf on the seventh day of his birth, his head is to be shaved, and he must be given a name.” Related by the five Imams (Ahmad and the four Imams). At-Tirmidhi graded it as Sahih.

    عَنْ اِبْنِ عُمَرَ رَضِيَ اَللَّهُ عَنْهُمَا, { عَنْ رَسُولِ اَللَّهِ – صلى الله عليه وسلم -أَنَّهُ أَدْرَكَ عُمَرَ بْنَ اَلْخَطَّابِ فِي رَكْبٍ, وَعُمَرَ يَحْلِفُ بِأَبِيهِ, فَنَادَاهُمْ رَسُولُ اَللَّهِ – صلى الله عليه وسلم – “أَلَا إِنَّ اَللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ, فَمَنْ كَانَ حَالِفاً فَلْيَحْلِفْ بِاَللَّهِ, أَوْ لِيَصْمُتْ” } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح. رواه البخاري ( 6646 )، ومسلم ( 1646 ) ( 3 ).

    Narrated Ibn ‘Umar (RA): Allah’s Messenger (صلى الله عليه وسلم) overtook ‘Umar bin al-Khattab when he was with a party of riders of about ten and ‘Umar was swearing by his father. Allah’s Messenger (صلى الله عليه وسلم) called them and said, “Verily! Allah forbids you from swearing by your fathers. Therefore, if anyone swears, he must swear by Allah or keep silent.” [Agreed upon]

    وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ, وَالنَّسَائِيِّ: عَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – { لَا تَحْلِفُوا بِآبَائِكُمْ, وَلَا بِأُمَّهَاتِكُمْ, وَلَا بِالْأَنْدَادِ, وَلَا تَحْلِفُوا إِلَّا بِاَللَّهِ, وَلَا تَحْلِفُوا بِاَللَّهِ إِلَّا وَأَنْتُمْ صَادِقُونَ” } 1 . 1 – صحيح. رواه أبو داود ( 3248 )، والنسائي ( 7 / 5 ).

    In a narration which is Marfu’ (attributed to the Prophet) reported by Abu Dawud and an-Nasa’i from Abu Hurairah (RA) it has: “Do not swear by your fathers, nor by your mothers, nor by the rivals (set up as equals with Allah); and do not swear by Allah except when you are speaking the truth.”

    وَعَنْ أَبِي هُرَيْرَةَ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ ” يَمِينُكَ عَلَى مَا يُصَدِّقُكَ بِهِ صَاحِبُكَ” } وَفِي رِوَايَةٍ: { “اَلْيَمِينُ عَلَى نِيَّةِ اَلْمُسْتَحْلِفِ” } أَخْرَجَهُمَا مُسْلِمٌ 1 . 1 – صحيح رواه مسلم ( 1653 ).

    Narrated Abu Hurairah (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “Your oath will be about that matter which your adversary has required you to swear about so that he will believe you.” In another narration: “An oath is to be interpreted according to the intention of the one who requested it (Al-Mustahlif).” [Muslim reported both narrations].

    وَعَنْ عَبْدِ اَلرَّحْمَنِ بْنِ سَمُرَةٍ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ وَإِذَا حَلَفْتَ عَلَى يَمِينٍ, فَرَأَيْتُ غَيْرَهَا خَيْراً مِنْهَا, فَكَفِّرْ عَنْ يَمِينِكَ, وَائْتِ اَلَّذِي هُوَ خَيْرٌ” } مُتَّفَقٌ عَلَيْهِ 1 . وَفِي لَفْظٍ لِلْبُخَارِيِّ: { ” فَائِت اَلَّذِي هُوَ خَيْرٌ, وَكَفِّرْ عَنْ يَمِينِكَ” } 2 . وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ: { ” فَكَفِّرْ عَنْ يَمِينِكَ, ثُمَّ اِئْتِ اَلَّذِي هُوَ خَيْرٌ” } وَإِسْنَادُهَا صَحِيحٌ 3 . 1 – صحيح. رواه البخاري ( 6622 )، ومسلم ( 1652 ). 2 – البخاري ( 6722 ). 3 – صحيح. أبو داود ( 3278 ).

    Narrated ‘Abdur-Rahman bin Samura (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “When you swear an oath and then consider something else to be better than it, make atonement for your oath and do the thing that is better.” [Agreed upon]. A wording of al-Bukhari has: “Do the thing that is better and make atonement for your oath.” In a narration by Abu Dawud: “Make atonement for your oath, then do the thing that is better.” [The chains of narrators of both Ahadith are Sahih (authentic)].

    وَعَنْ اِبْنِ عُمَرَ رَضِيَ اَللَّهُ عَنْهُمَا; أَنَّ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -قَالَ: { “مَنْ حَلِفِ عَلَى يَمِينٍ فَقَالَ: إِنْ شَاءَ اَللَّهُ, فَلَا حِنْثَ عَلَيْهِ” } رَوَاهُ اَلْخَمْسَةُ 1 . وَصَحَّحَهُ اِبْنُ حِبَّانَ 2 . 1 – كذا “بالأصلين” وأشار ناسخ “أ” في الهامش إلى نسخة: “أحمد والأربعة”. 2 – صحيح. رواه أحمد ( 2 / 10 )، وأبو داود ( 3261 )، والنسائي ( 7 / 25 )، والترمذي ( 1531 )، وابن ماجه ( 2105 )، وابن حبان ( 1184 ). قلت: اللفظ للترمذي؛ إلا أنه زاد: “فقد استثنى” بعد قوله: “إن شاء الله” ، وإلى هذه الزيادة دون الجملة الأخيرة رواه أبو داود. والنسائي وأحمد. وأما لفظ ابن حبان فهو: “من حلف فقال: إن شاء الله، لم يحنث” . ولفظ ابن ماجه: ” من حلف واستثنى، إن شاء رجع، وإن شاء ترك، غير حانث” . وهو أيضا لبعضهم، وله ألفاظ أخرى، ذكرتها مفصلة مع طرقها في “الأصل”.

    Narrated Ibn ‘Umar (RA): “Allah’s Messenger (صلى الله عليه وسلم) said: “Whoever swears an oath, and then says: “If Allah Wills”, he is not held accountable if he breaks it.” [Ahmad and al-Arba’a reported it, and Ibn Hibban graded it Sahih (authentic)].

    وَعَنْ جَابِرٍ – رضى الله عنه – قَالَ: قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ “لَا تَذْبَحُوا إِلَّا مُسِنَّةً, إِلَّا أَنْ يَعْسُرَ عَلَيْكُمْ فَتَذْبَحُوا جَذَعَةً مِنَ اَلضَّأْنِ” } رَوَاهُ مُسْلِم ٌ (1772) . 4 – ضعيف. رواه مسلم ( 1963 ) وهو من رواية أبي الزبير، عن جابر من غير طريق الليث بن سعد، وهي رواية ضعيفة إذا لم يصرح أبو الزبير بالسماع، وفي “الأصل” رد مفصل على من أنكر تضعيفه لوجوده في “صحيح” مسلم ليس أكثر، مع أنه هو يرد أحاديث في “صحيح” مسلم دون أدلة علمية – إلا مجرد العقل – بل ولم يسبقه إلى ذلك أحد، كرده لحديث تميم الداري المشهور والمعروف بحديث الجساسة.

    Jabir (RAA) narrated that Allah’s Messenger (صلى الله عليه وسلم) said: “Sacrifice only a full-grown animal unless it is difficult for you, in which case you should sacrifice a (six to ten month old) sheep.” Reported by Muslim.

    وَعَنْ عَلِيٍّ – رضى الله عنه – قَالَ: { أَمَرَنَا رَسُولُ اَللَّهِ – صلى الله عليه وسلم -أَنْ نَسْتَشْرِفَ اَلْعَيْنَ وَالْأُذُنَ, وَلَا نُضَحِّيَ بِعَوْرَاءَ, وَلَا مُقَابَلَةٍ, وَلَا مُدَابَرَةٍ, وَلَا خَرْمَاءَ, وَلَا ثَرْمَاءَ” } أَخْرَجَهُ أَحْمَدُ, وَالْأَرْبَعَة ُ (1773) . وَصَحَّحَهُ اَلتِّرْمِذِيُّ, وَابْنُ حِبَّانَ, وَالْحَاكِم ُ (1774) . 1 – كذا “الأصل” وفي “أ” : “الخمسة”. 2 – ضعيف. وفي “الأصل” تفصيل طرقه ورواياته.

    ‘Ali (RAA) narrated, ‘Allah’s Messenger (صلى الله عليه وسلم) enjoined us to pay great attention to the eye and the ear and not sacrifice a one-eyed animal with a slit which leaves something hanging at the front or back of the ear, or with a perforation in the ear, or an animal with broken front teeth.’ Related by Ahmad and the four Imams. At-Tirmidhi, Ibn Hibban and Al-Hakim graded it as Sahih.

    وَعَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ – رضى الله عنه – قَالَ: { + أَمَرَنِي اَلنَّبِيُّ – صلى الله عليه وسلم -أَنَّ أَقْوَمَ عَلَى بُدْنِهِ, وَأَنْ أُقَسِّمَ لُحُومَهَا وَجُلُودَهَا وَجِلَالَهَا عَلَى اَلْمَسَاكِينِ, وَلَا أُعْطِيَ فِي جِزَارَتِهَا مِنْهَا شَيْئاً } مُتَّفَقٌ عَلَيْه ِ (1775) . 3 – صحيح. رواه البخاري ( 1707 )، ومسلم ( 1317 ) بنحوه.

    ‘Ali bin Abi Talib (RAA) narrated, “The Messenger of Allah (صلى الله عليه وسلم) appointed me to be in charge of his sacrificial animals, and commanded me to distribute all their meat, hides and saddlery to the poor, and not to give anything from them to the butcher.” Agreed upon.

    وَعَنْ جَابِرِ بنِ عَبْدِ اَللَّهِ رَضِيَ اَللَّهُ عَنْهُمَا قَالَ: { نَحَرْنَا مَعَ اَلنَّبِيِّ – صلى الله عليه وسلم -عَامَ اَلْحُدَيْبِيَةِ: اَلْبَدَنَةَ عَنْ سَبْعَةٍ, وَالْبَقَرَةَ عَنْ سَبْعَةٍ } رَوَاهُ مُسْلِم ٌ (1776) . 4 – صحيح. رواه مسلم ( 1318 ).

    Jabir (RAA) narrated, ‘In the year of Hudaibiyah (Reconciliation), we sacrificed a camel for each seven people along with Allah’s Messenger (صلى الله عليه وسلم), and also a cow for seven. ‘Related by Muslim.
