    وَعَنِ ابْنِ عَبَّاسٍ – رَضِيَ اَللَّهُ عَنْهُمَا- قَالَ : { لَمَّا تَزَوَّجَ عَلِيٌّ فَاطِمَةَ -عَلَيْهِمَا اَلسَّلَامُ- . قَالَ لَهُ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” أَعْطِهَا شَيْئًا ” , قَالَ : مَا عِنْدِي شَيْءٌ . قَالَ :” فَأَيْنَ دِرْعُكَ الحُطَمِيَّةُ ? } رَوَاهُ أَبُو دَاوُدَ , وَالنَّسَائِيُّ , وَصَحَّحَهُ اَلْحَاكِمُ 1 . 1 – صحيح . رواه أبو داود (2125) ، والنسائي (6 / 130) . الحطمية . قال في ” النهاية ” ( 1 / 402 ) : ” هي التي تحطم السيوف ؛ أي : تكسرها ، وقيل : هي العريضة الثقيلة . وقيل : هي منسوبة إلى بطن من عبد القيس يقال لهم : حطمة بن محارب ، كانوا يعملون بالدروع ، وهذا أشبه بالأقوال “.

    Narrated Ibn ‘Abbas (RA): When ‘Ali (RA) married Fatimah (RA) Allah’s Messenger (صلى الله عليه وسلم) said to him, “Give her something (as dowry).” He replied, “I have nothing.” He said, “Where is your Hutamiya coat of mail?” [Reported by Abu Dawud and an-Nasa’i; al-Hakim graded it Sahih (authentic)].

    وَعَنْ عَمْرِو بْنِ شُعَيْبٍ , عَنْ أَبِيهِ , عَنْ جَدِّهِ قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ أَيُّمَا اِمْرَأَةٍ نَكَحَتْ عَلَى صَدَاقٍ , أَوْ حِبَاءٍ , أَوْ عِدَةٍ , قَبْلَ عِصْمَةِ اَلنِّكَاحِ , فَهُوَ لَهَا, وَمَا كَانَ بَعْدَ عِصْمَةِ اَلنِّكَاحِ , فَهُوَ لِمَنْ أُعْطِيَهُ, وَأَحَقُّ مَا أُكْرِمَ اَلرَّجُلُ عَلَيْهِ اِبْنَتُهُ , أَوْ أُخْتُهُ } رَوَاهُ أَحْمَدُ , وَالْأَرْبَعَةُ إِلَّا اَلتِّرْمِذِيَّ 1 . 1 – ضعيف . رواه أحمد ( 2 / 182 ) ، وأبو داود ( 2129 ) ، والنسائي ( 6 / 120 ) ، وابن ماجه ( 1955 ) من طريق ابن جريج ، عن عمرو ، به . وعلته عنعنة ابن جريج ، فهو مدلس.

    Narrated ‘Amr bin Shu’aib on his father’s authority from his grandfather: Allah’s Messenger (صلى الله عليه وسلم) said: “If any woman marries for a dowry, a gift, or a promise before contracting the marriage, it belongs to her. As for whatever is fixed to her after contracting the marriage, it belongs to whomever it has been given. The most worthy gift a man is honored with is what he gets on account of (the marriage of) his daughter or sister.” [Reported by Ahmad and al-Arba’a except at-Tirmidhi].

    وَعَنْ عَلْقَمَةَ , عَنِ ابْنِ مَسْعُودٍ – رضى الله عنه – { أَنَّهُ سُئِلَ عَنْ رَجُلٍ تَزَوَّجَ اِمْرَأَةً , وَلَمْ يَفْرِضْ لَهَا صَدَاقًا , وَلَمْ يَدْخُلْ بِهَا حَتَّى مَاتَ , فَقَالَ اِبْنُ مَسْعُودٍ : لَهَا مِثْلُ صَدَاقِ نِسَائِهَا , لَا وَكْسَ , وَلَا شَطَطَ , وَعَلَيْهَا اَلْعِدَّةُ , وَلَهَا اَلْمِيرَاثُ، فَقَامَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ فَقَالَ : قَضَى رَسُولُ اَللَّهِ – صلى الله عليه وسلم -فِي بِرْوَعَ بِنْتِ وَاشِقٍ – اِمْرَأَةٍ مِنَّا – مِثْلَ مَا قَضَيْتَ , فَفَرِحَ بِهَا اِبْنُ مَسْعُودٍ } رَوَاهُ أَحْمَدُ , وَالْأَرْبَعَةُ , وَصَحَّحَهُ اَلتِّرْمِذِيُّ وَالْجَمَاعَةُ 1 1032 – وَعَنْ جَابِرِ بْنِ عَبْدِ اَللَّهِ – رَضِيَ اَللَّهُ عَنْهُمَا- { أَنَّ اَلنَّبِيَّ – صلى الله عليه وسلم -قَالَ : ” مَنْ أَعْطَى فِي صَدَاقِ اِمْرَأَةٍ 2 سَوِيقًا , أَوْ تَمْرًا , فَقَدْ اِسْتَحَلَّ } أَخْرَجَهُ أَبُو دَاوُدَ , وَأَشَارَ إِلَى تَرْجِيحِ وَقْفِهِ 3 . 1 – صحيح . رواه أحمد ( 4 79 – 280 ) ، وأبو داود (2115) ، والنسائي (6 21) ، والترمذي ( 1145 ) ، وابن ماجه ( 1891 ) . وقال الترمذي : ” حسن صحيح ” . الوكس : النقص ؛ أي : لا ينقص عن مهر نسائها . والشطط : الجور ؛ أي : لا يجار على زوجها بزيادة مهرها على نسائها. 2 – وفي سنن أبي داود زيادة : ” ملء كفيه “. 3 – ضعيف رواه أبو داود ( 2110 ) من طريق موسى بن مسلم بن رومان ، عن أبي الزبير ، عن جابر ، به . قال الحافظ في ” التلخيص” ( 3 / 190 ) : ” وفي إسناده ابن رومان ، وهو ضعيف ” . قلت : وأيضا أبو الزبير مدلس ، وقد عنعنه ، وقد صرح في بعض المصادر إلا أن أسانيدها مهلهلة. انظر ” ناسخ الحديث ” لابن شاهين ( 507 ).

    Narrated ‘Alqamah on the authority of Ibn Mas’ud (RA): He was asked about a man who had married a woman and had not fixed a dowry for her. And he did not consummate (the marriage) with her till he died. Ibn Mas’ud replied, “She should receive a dowry similar to what the women of her community receive without decrease or increase. She must observe the ‘Iddah period (of waiting before re-marrying and is entitled to a share of the inheritance.” Ma’qil bin Sinan al-Ashja’i then got up and said, “Allah’s Messenger (صلى الله عليه وسلم) ruled the same as your ruling regarding Birwa’, daughter of Washiq, a woman of our tribe.” Ibn Mas’ud was delighted with it. [Reported by Ahmad and al-Arba’a. at-Tirmidhi graded it Sahih (authentic), while a group (of Hadith scholars) graded it Hasan (good)]. Narrated Jabir bin ‘Abdullah (RA): The Prophet (صلى الله عليه وسلم) said: “If anyone gives as a dowry to a woman some flour or dates, he has made her lawful for himself.” [Abu Dawud reported it, and indicated that the stronger opinion is that it is Mawquf (saying of a Companion)].

    وَعَنْ جُذَامَةَ بِنْتِ وَهْبٍ -رَضِيَ اَللَّهُ عَنْهَا- قَالَتْ : { حَضَرْتُ رَسُولَ اَللَّهِ – صلى الله عليه وسلم -فِي أُنَاسٍ , وَهُوَ يَقُولُ : لَقَدْ هَمَمْتُ أَنْ أَنْهَى عَنِ الْغِيلَةِ , فَنَظَرْتُ فِي اَلرُّومِ وَفَارِسَ , فَإِذَا هُمْ يُغِيلُونَ أَوْلَادَهُمْ فَلَا يَضُرُّ ذَلِكَ أَوْلَادَهُمْ شَيْئًا ” . ثُمَّ سَأَلُوهُ عَنِ الْعَزْلِ ? فَقَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -” ذَلِكَ اَلْوَأْدُ اَلْخَفِيُّ } رَوَاهُ مُسْلِمٌ 1 . 1 – صحيح . رواه مسلم ( 1442 ) ( 141 ) من طريق سعيد بن أبي أيوب ، حدثني أبو الأسود ، عن عروة ، عن عائشة ، عن جذامة ، به . وقد ضعف بعضهم هذا الحديث ؛ لتعارضه مع الحديث التالي ، ولهم في ذلك علل أشبه بالأوهام حتى قال الحافظ في ” الفتح ” ( 9 / 309 ) في معرض الرد عليهم : ” وهذا دفع للأحاديث الصحيحة بالتوهم ، والحديث صحيح لا ريب فيه” . وانظر ما بعده.

    Narrated Judamah (RA) daughter of Wahb: I was with Allah’s Messenger (صلى الله عليه وسلم) along with some people when he was saying, “I have intended to prohibit Ghila (sexual intercourse with a woman who is breast-feeding), but I considered the Romans and the Persians and saw that they engaged in Ghila without any injury being caused to their children thereby.” Then they asked him about ‘Azl (withdrawing the penis before emission of semen, to avoid conception), and Allah’s Messenger (صلى الله عليه وسلم) replied, “That is the secret (way of) burying alive.” [Reported by Muslim]

    وَعَنْ أَبِي سَعِيدٍ اَلْخُدْرِيِّ – رضى الله عنه – { أَنَّ رَجُلاً قَالَ : يَا رَسُولَ اَللَّهِ ! إِنَّ لِي جَارِيَةً , وَأَنَا أَعْزِلُ عَنْهَا , وَأَنَا أَكْرَهُ أَنْ تَحْمِلَ , وَأَنَا أُرِيدُ مَا يُرِيدُ اَلرِّجَالُ , وَإِنَّ اَلْيَهُودَ تُحَدِّثُ: أَنَّ اَلْعَزْلَ المَوْؤُدَةُ اَلصُّغْرَى . قَالَ : ” كَذَبَتْ يَهُودُ , لَوْ أَرَادَ اَللَّهُ أَنْ يَخْلُقَهُ مَا اِسْتَطَعْتَ أَنْ تَصْرِفَهُ } رَوَاهُ أَحْمَدُ , وَأَبُو دَاوُدَ وَاللَّفْظُ لَهُ , وَالنَّسَائِيُّ , وَاَلطَّحَاوِيُّ , وَرِجَالُهُ ثِقَاتٌ 1 . 1 – صحيح . رواه أحمد ( 3 / 33 و 51 و 53 ) ، وأبو داود ( 2171 ) ، والنسائي في ” عشرة النساء ” ( 194 ) ، والطحاوي في ” المشكل ” ( 1916 ).

    Narrated Abu Sa’id al-Khudri (RA): A man said, “O Allah’s Messenger, I have a slave-girl and I withdraw the penis while having intercourse with her (‘Azl). I dislike that she become pregnant, but I want (from her) what a man wants (from a woman). And the Jews say – withdrawing the penis to avoid conception is the minor (form of) burying alive.” He replied, “The Jews told a lie, for if Allah intended to create it you would not be able to turn it away.” [Reported by Ahmad and Abu Dawud, the wording is Abu Dawud’s. an-Nasa’i and at-Tahawi also reported it. Its narrators are reliable].

    وَعَنْ جَابِرٍ – رضى الله عنه – قَالَ : { كُنَّا نَعْزِلُ عَلَى عَهْدِ رَسُولِ اَللَّهِ – صلى الله عليه وسلم -وَالْقُرْآنُ يَنْزِلُ , وَلَوْ كَانَ شَيْئًا يُنْهَى عَنْهُ لَنَهَانَا عَنْهُ اَلْقُرْآنُ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح . رواه البخاري 9 / 305 / فتح ) ، ومسلم ( 1440 ) . ” تنبيه ” : عزو الحديث بهذا التمام للبخاري ومسلم وهم من الحافظ – رحمه الله – إذ المتفق عليه إلى قوله : ” والقرآن ينزل” . وأما هذه الزيادة : ” لو كان شيئا . . . ” فرواها مسلم وحده من طريق إسحاق بن راهويه قال : قال سفيان : ” لو كان شيئا . . . ” فإدراج الحافظ لها في الحديث وهم ، وعزوها إلى الشيخين وهم آخر ، بل هو نفسه -رحمه الله- قال في ” الفتح ” . ” هذا ظاهر في أن سفيان قاله استنباطا ، وأوهم كلام صاحب ” العمدة ” ومن تبعه أن هذه الزيادة من نفس الحديث فأدرجها ، وليس الأمر كذلك ؛ فإني تتبعته من المسانيد ، فوجدت أكثر رواته عن سفيان لا يذكرون هذه الزيادة “.

    Narrated Jabir (RA): In the lifetime of Allah’s Messenger (صلى الله عليه وسلم) when the Qur’an was being revealed, we used to engage in ‘Azl. Hence, if it had been something forbidden, the Qur’an would have forbade us from doing it. [Agreed upon].

    وَلِمُسْلِمٍ : { فَإِنْ اِسْتَمْتَعْتَ بِهَا اِسْتَمْتَعْتَ وَبِهَا عِوَجٌ , وَإِنْ ذَهَبْتَ تُقِيمُهَا كَسَرْتَهَا , وَكَسْرُهَا طَلَاقُهَا } 1 . 1 – صحيح . وهي رواية مسلم (61).

    Muslim has: “So if you enjoy her you will do so while crookedness remains in her; but if you attempt to straighten her you will break her, and breaking her is divorcing her.”

    وَعَنْ جَابِرٍ – رضى الله عنه – قَالَ : { كُنَّا مَعَ رَسُولِ اَللَّهِ – صلى الله عليه وسلم -فِي غَزَاةٍ , فَلَمَّا قَدِمْنَا اَلْمَدِينَةَ , ذَهَبْنَا لِنَدْخُلَ . فَقَالَ : ” أَمْهِلُوا حَتَّى تَدْخُلُوا لَيْلًا – يَعْنِي : عِشَاءً – لِكَيْ تَمْتَشِطَ اَلشَّعِثَةُ , وَتَسْتَحِدَّ اَلْمَغِيبَةُ } مُتَّفَقٌ عَلَيْهِ 1 . 1 – صحيح . رواه البخاري (5079) ، ومسلم (715) (57) واللفظ للبخاري وهو عندهما مطول.

    Narrated Jabir (RA): We were with the Prophet (صلى الله عليه وسلم) on an expedition. Then, when we arrived at al-Madinah and were about to enter he said, “Wait so that you may enter by night – i.e. in the evening in order that the woman with disheveled hair may comb it and the woman whose husband has been away may shave her pubic hairs (getting ready for her husband).” [Agreed upon].

    وَفِي رِوَايَةٍ لِلْبُخَارِيِّ : { إِذَا أَطَالَ 1 أَحَدُكُمُ الْغَيْبَةَ , فَلَا يَطْرُقْ أَهْلَهُ لَيْلاً } 2 . 1 – في ” أ ” : ” طال ” وهو تحريف. 2 – صحيح . رواه البخاري ( 5244 ).

    A narration by al-Bukhari has: “When one of you has been away from home for a long time, he must not come to his family during the night.”

    وَعَنْ أَبِي سَعِيدٍ اَلْخُدْرِيِّ – رضى الله عنه – قَالَ : قَالَ رَسُولُ اَللَّهِ – صلى الله عليه وسلم -{ إِنَّ شَرَّ اَلنَّاسِ مَنْزِلَةً عِنْدَ اَللَّهِ يَوْمَ اَلْقِيَامَةِ ; اَلرَّجُلُ يُفْضِي إِلَى اِمْرَأَتِهِ وَتُفْضِي إِلَيْهِ , ثُمَّ يَنْشُرُ سِرَّهَا } أَخْرَجَهُ مُسْلِمٌ 1 . 1 – منكر . رواه مسلم ( 1437 ) . وآفته عمر بن حمزة قال عنه أحمد في ” العلل ” ( 2 / 44 / 317 ) أحاديثه أحاديث مناكير . وقال الذهبي في ” الكاشف ” : ” ضعفه ابن معين والنسائي” ثم أضاف إلى ذلك كلمة أحمد السابقة. وقال الحافظ في ” التقريب” : ” ضعيف ” . ونص الذهبي في ” الميزان ” ( 3 / 192 ) على هذا الحديث ، وأنه : ” مما استنكر لعمر “.

    Narrated Abu Sa’id al-Khudri (RA): Allah’s Messenger (صلى الله عليه وسلم) said: “The worst of people in position before Allah on the Day of Resurrection is the man who has intercourse with his wife, and she with him, and then spreads her secrets.” [Reported by Muslim].
